Goodell has shown a propensity to come down harder on repeat offenders and the pats got a 250k fine and a 1st rounder for spygate. I don't think this is as big a deal (in the eye of the public), but they're still getting ripped for it. Goodell will come down on this I believe.

More probable than not is a legal term. Its how lawyers write reports. Its the equivalent of "beyond a reasonable doubt" for a criminal trial.
The Patriots organization did nothing wrong... just their hired employees and franchise player. And coach if you go by the Payton precedent of "ignorance is no excuse".

Celeras isn't wrong, but his initial comment about it, while again not wrong, was kinda worded in a way to skew in his favor.
He's saying that more probable than not/preponderance of evidence is the burden of proof required in civil cases, and it's equivalent in a criminal case is beyond a reasonable doubt.
The way he was wording it that post was fairly easy to interpret as implying that more probable than not and beyond a reasonable doubt are the same thing.
