    The Lauderdale County prisoner had originally filed a federal lawsuit last week against a local sheriff, seeking a court order that would clear the way for an abortion. A federal judge had said he would rule by Friday on her request.

    In the meantime, the state had sought to terminate her parental rights over the unborn child.

    Lauderdale County District Attorney Chris Connolly recently said the prisoner in question would be stripped of her legal standing to seek an abortion if the court took away her parental rights. Connolly said via email that he filed the request on the state's behalf.

    The woman, who filed suit July 20 against Sheriff Rick Singleton, said in the earlier court documents that she was unable to obtain an abortion before going to jail, and denying her one violates her constitutional rights. Court papers do not say why the woman is in custody or provide any personal information about her, but Connolly said she is an adult. A court-appointed attorney was named to act as guardian for the fetus.

    The woman, who is in her first trimester of pregnancy, had at the time urged a federal judge to order the county to let her leave jail to have an abortion that she planned to pay for privately. Her ACLU attorney, Marshall, had said a federal court ruling in favor of the woman would trump an attempt by the state to stop her from having the procedure.
    Women decided to not go through with it, but speculation among random people are saying that the state is putting far to much pressure on her. Especially being a prisoner.

    Stripping a pregnant woman rights of parenthood and giving the fetus over to the state. Scary as fuck to be a women in this case.

    Scary as fuck but it's something that needs a precedent set for. Really scary though, and I hope a really good lawyer helps her out pro bono if need be.

    Ugh I don't like the sounds of that at all. I'm interested to see where this goes and hopeful that the right decision is made in this case.

    Is this like slavery where the baby has to be raised in prison so the prison can take more federal money

    “This lawsuit is about Jane Doe’s constitutional right to make her own determination regarding her pregnancy rather than the state, a state court judge, the district attorney, or the sheriff,” said Randall Marshall, legal director of the ACLU of Alabama, who was representing Jane Doe in her petition to leave the jail for an abortion. “If this is truly her decision, it must be respected. However, the circumstances under which this affidavit was obtained are highly suspicious and we are in the process of trying to determine Ms. Doe’s true wishes.”

    Brigitte Amiri, an attorney with the ACLU Reproductive Freedom Project who is also working on the case, told msnbc, “Our concern is that this has come quickly and has come quite contrary to her strong desire, expressed multiple times, that she obtain an abortion.” The meeting that resulted in the affidavit came as Elizabeth Berry, a criminal defense attorney who has worked most closely with Jane Doe in Florence, was traveling.
    District attorney Chris Connolly moved earlier this week to terminate Jane Doe’s parental rights, apparently to block her from having an abortion. To reporters, he cited an Alabama Supreme Court decision that allowed pregnant women to be charged under chemical endangerment laws, and contrary to the wishes of Jane Doe’s attorneys to keep her charges private, said she faced such a charge. Marshall told msnbc that the Supreme Court decision didn’t apply, because that opinion concerned only post-viability fetuses, and the woman has a constitutional right to end her pregnancy before viability.
