Would they though? This is where my friend and I disagreed, he had your point of view. But without a physical presence to shut down, what could they do? Call Nintendo directly and tell them to shut this shit down? Best they could do would be to dismantle the crowds, but I don't think it'd be feasible without riots and such.
It really opens the door to what apps like this can and can't do. There's already been numerous reports of poorly placed Pokestops and Gyms disrupting people's lives or privacy. Was some story of a guy that lived in a converted old church that had been made a gym. He now gets dozens of people on his yard battling it out, and beyond Niotic's slow removal process, he really has no recourse. Not to say he should be a dick about it, but I'd get annoyed too if people constantly came into my yard for the game.
I googled around for court issues with Geocaching and Ingress but didn't really come up with anything beyond a few stories of overzealous cops thinking they had a psychotic person on their hands, when in reality they really were closing portals and stopping the Resistance. I did find an article that makes some interesting points from four years ago.
The Future
By all accounts, Niantic labs has been responsible about these issues. The game doesn’t encourage trespassing or dangerous behavior, like using your phone in a car. Other developers may not feel the same sense of duty, or their goals may encourage “creative” players to take unnecessary risks.
If enough negligence, trespassing, and public nuisance suits (and maybe some claims of police harassment) hit the courts, we’ll eventually wind up with legislation governing the balance between gameplay and public safety. We might see an increase of no-device buffer zones around sensitive areas, or certain games limiting accounts to only users of age to accept legal responsibility for their actions. There could even be outright bans on AR games in certain areas.
Until then, it’s up to game developers to police themselves and players to stay smart. One dumb move could lead to a ton of regulation that could really spoil everyone’s fun.

I don't think that's how it'll work. It'll be a global effort, not just those that can physically be in Times Square. I think it's more likely it'll be something surrounding gyms or the like. Say, owning a certain number of gyms, or being in control of areas/region, similar to how Ingress does it.
For example, perhaps owning the gyms surrounding a -- or inside of a -- certain geographical location (Times Square for example) makes Mewtwo spawn there for the team in control of the area, allowing them to fight it while in control of the area. And the team that manage to deal the most amount of damage to Mewtwo during the event gets mewtwo as a reward. That would allow everyone around the world -- no matter where they might live -- to help out their team. I highly doubt they'd require everyone to buttfuck Times Square, that would create chaos and I'm sure they realize that.
Yes, I know, the trailer had everyone fighting in Times Square and cheering, but that was a trailer and not reality.
With reports of legendaries being sighted today, I doubt Times Square will be a thing.

Even if Nintendo officials aren't there, they'd still be held responsible for the event. Depending on the size, this could also lead to legal or financial recourse. They would send out police, in riot gear if needed, to disperse the crowd and then have the event cancelled one way or another.
What event? That's kinda what I'm trying to get at. There's not an actual physical event going on. There's something in an augmented reality app that is drawing people. There is no precedent thus far, and that's what interests me. There's nothing about any sort of government having to step in to stop anything AR related, only detaining people. And if the crowds were so big, that'd be impossible.
FWIW, discussion isn't about how they'll handle legendaries. I agree 100%, having a single real life location would be a disaster. Whether it's multiple locations all over the place to spread people out, or a world wide event that feeds on the tears of server issues, or any other solution, there's multiple better ways to handle it. It's the fact that they have this ability, whether they use it or not, that's interesting. I mean, they could even go as far as to not plan it. Make an algorithm that picks the highest traffic area, or lowest to make people travel, and bam, notification goes out that x legendary is there. People would gather no doubt. What other media or platform has had that sort of gathering power? Nothing comes to mind.

I guess my stance is that it is a "physical event" going on. The company that puts out the app would be telling people to be at a certain place at a certain time in order to participate in the event. By telling people this they are making themselves the organizers; they are responsible for what happens in this location at the given times.
Even though it's an app, and the content of the event is purely virtual, that doesn't mean that it only occurs in augmented reality. The fact that you have to be in a physical location is the deal breaker.
Now, if a Mewtwo randomly spawned in an area and the people that were already in the area rushed over, I think in that case the company could not be held responsible. That would be caused by an algorithm in a program that made it spawn; it was not "organized," it simply was a "happening."
