The Brock case would at least be a little more interesting if he was blacked out drunk as well - couldn't answer questions about how he ended up in the alley with the girl, etc - was a blank slate like she was. As it stands his defense was pretty ridiculous.
The key to that case is that having no memory doesn't mean you were unconscious. The nature of a blackout drunken stupor is simply that you don't remember what happened, not that you were passed out. It's entirely plausible that she was willingly engaging in his sexual advances. After all, people would notice if someone was physically carrying an unconscious girl out of a party and into an alley. That looks shady as fuck. Two drunk people stumbling into a private area? Totally normal occurrence at parties.
Totally. That's why it's so damning that he supposedly remembers everything - a girl who is 3 times the legal limit, who passed out (at the latest) during the assault, would be blindingly obvious that she couldn't give meaningful consent.

No, the point is that the blackout amnesia is the only symptom you have in blackout drunkenness. You can appear far, far less drunk than you actually are, depending on personality and how drunkenness affects you personally.

The thing is that you can't give legally give consent when you are drunk. It doesn't matter if she said yes if it was under the influence.
Now if they were equally drunk the issue becomes ambiguous because then neither party has consent, and you can't plead voluntary intoxication for rape.
They were definitely both drunk, and this conversation has been hashed out a hundred times in the feminism thread. The concept of rape becomes a horrible mess when people start drinking, but it's stupid to take the perspective that "legal consent" should have any bearing in a normal social interaction.
