Is that the lasting legacy you want? They snuck in a SCJ...I'll be surprised if it is even possible, but the one vacancy isn't the prize. There will likely be 1 or 2 more spots to fill while trump is in office.

I thought people were saying he could do that during the summer recess too, but that it would only be temporary till Congress met.

After the SCOTUS ruling about recess appointments I don't know if that's even viable anymore. Cant McConnell just have a quorum rolling thru the end of Congress recess, or do they absolutely have to adjourn for a certain amount of time before the new Congress is seated?

Edit: nvm, start of next session would be when the new Congress is seated in January. FUCK.

I believe that in order for a recess appointment to work a congress must be 3+ day recess, this means no members returning at any point for minor legislative action.

However, in the case of such a recess Obama could indeed push through a recess appointment to fill the void... though the appointment only lasts until the start of the next legislative session at which time the temporary position is revoked unless approved by congress.

Someone feel free to correct anywhere I may be incorrect.

Republicans have literally thrown a tantrum over wanting to decide who they want to be nominated. So much so they declared to block a SCJ for the next 4 years if Hillary gets in. So yes any decision not in the hands of the current Republicans is a good thing.

Nevada voters have to be pissed. They were so on the knife's edge, came through for Hillary AND got Cortez-Masto in the Senate to replace Harry Reid,did everything they needed to do...and every other state failed them completely, especially Wisconsin and Pennsylvania.
