While done under wartime effects and in response to Pearl Harbor there is no requirement for the US to be at war for these things to reoccur. And fuck we're already so balls deep on this "War on Terror" shit mess and fatigue that it wouldn't take much for Trump to do something very similar and be just kosher enough to slide.
And the Espionage Act of 1917, with moderate rewording, is still in existence today. It's also kinda the reason why Snowden isn't on US soil.

Democrats have a narrow path to remaining relevant:
1) Prevent the Republicans from gaining control of the remaining (7?) state legislatures they would need in order to have partisan constitutional amendment abilities.
2) Hold onto their 25 senate seats up for reelection in 2018 and perhaps pick up one more.
3) Hopefully push back the Republican ground game and regain control of some state legislatures in order to remove shitty voter suppression legislation and enact things like mail voting.
4) Incense their base so they actually help with any of #1-3
Step #4 is totally essential to accomplishing steps #1-3. If we sit back and just 'member the Bush administration where we failed to do this and it could have been worse (perhaps hereafter referred to as Trumpbad), then we won't accomplish steps 1-3.
Panic is the correct response right now -- a bunch of flat-out crazy and dangerous people are about to assume power and way too many people are like "hey let's give these guys a chance" as if there's any indication this won't be a complete disaster for the country.
Right now DNC's making some moves that look good but ultimate don't do anything to treat the root cause of the issue. But at the same time its been hardly a week so these motions at least give me some comfort.
2018 looks bad but I think the DNC can pull it off if they don't repeat a 2014 'Fuck obama' approach.
They have no shot at taking the Senate or House in 2018. In 2018 they need to focus on state legislatures. Controlling state legislatures in 2018 would let them un-gerrymander areas in time for 2020, which is going to be important because the house of representatives will have its seats redistributed based on the 2020 census. That will likely give Republicans a net gain of 5 seats in the house (based on the 2014 census projections and assuming that red states stay red).
