    Senators Blame Obama For Not Helping Them Understand Their Own Bill

    Last Friday, President Barack Obama vetoed a bill called the Justice Against Sponsors of Terrorism Act, better known as JASTA. The bill, which enjoyed broad bipartisan support in both houses of Congress, would, among other things, have allowed plaintiffs to sue countries known to have sponsored terrorist acts for compensatory damages. Many of the bill’s supporters had pitched JASTA as a “sue Saudi Arabia” bill, based on their insistent belief that Saudi Arabia was behind the Sept. 11 attacks. The bill’s supporters in Congress frequently cited the 9/11 attacks as their motivation for passing the bill in the first place.

    (Sec. 3) This bill amends the federal judicial code to narrow the scope of foreign sovereign immunity (i.e., a foreign state's immunity from the jurisdiction of U.S. courts).

    Specifically, it authorizes federal court jurisdiction over a civil claim against a foreign state for physical injury to a person or property or death that occurs inside the United States as a result of: (1) an act of international terrorism, and (2) a tort committed anywhere by an official, agent, or employee of a foreign state acting within the scope of employment.

    International terrorism does not include an act of war. Federal court jurisdiction does not extend to a tort claim based on an omission or an act that is merely negligent.

    A U.S. national may file a civil action against a foreign state for physical injury, death, or damage as a result of an act of international terrorism committed by a designated terrorist organization.

    (Sec. 4) The bill amends the federal criminal code to impose civil liability on a person who conspires to commit or aids and abets (by knowingly providing substantial assistance) an act of international terrorism committed, planned, or authorized by a designated terrorist organization.

    (Sec. 5) It establishes exclusive federal court jurisdiction over civil claims under this bill.

    It authorizes the Department of Justice (DOJ) to intervene in civil proceedings to seek a stay. A court may grant the stay if the Department of State certifies that the United States is engaged in good-faith discussions with the foreign state to resolve the civil claims.

    (Sec. 7) This bill's amendments apply to a civil claim: (1) pending on or commenced on or after enactment; and (2) arising out of an injury to a person, property, or business on or after September 11, 2001.



    I started a new thread for this fiasco because it is going to bring a lot of potential grief if nothing is done. Take for instance the potential for lawsuits that could be implemented towards our military personnel despite being ordered or all those drone strikes killing innocent civilians. Its also going to give nations pause when allocating money on U.S. territory. Already the first lawsuit towards Saudi Arabia has been implemented, where it goes, well we shall see.

    First Lawsuit:

    Washington (CNN)Stephanie DeSimone was two months pregnant when her husband, Navy Cmdr. Patrick Dunn, was killed at the Pentagon on September 11, 2001.

    Now, 15 years later -- and two days after Congress legally paved the way -- she's filed a lawsuit against Saudi Arabia, claiming the kingdom is partially responsible for his death.
    In court documents filed Friday in Washington, D.C., DeSimone alleges Saudi Arabia provided material support to al Qaeda for more than a decade and was aware of the terror group's plan to attack the US.
    "Absent the support provided by the Kingdom, al Qaeda would not have possessed the capacity to conceive, plan, and execute the September 11th attacks," the documents say.
    The lawsuit alleges that the plaintiffs -- which include DeSimone's daughter -- suffered "severe and permanent personal injuries" and are seeking unspecified compensation.
    The documents go on to allege Saudi Arabia, through agents and purported charities, provided al Qaeda members with financial and other logistical support to carry out the attacks.
    Messages left Saturday with the Saudi embassy in Washington were not immediately returned.

    Lawyers Move Quickly After Congress Enacts Bill Allowing Suits Against Saudi Arabia

    WASHINGTON—Attorneys for Sept. 11 victim families with legal claims already pending in court said Friday they are moving quickly to take advantage of a new law exposing Saudi Arabia to potential liability for the 2001 terror attacks.

    James Kreindler, whose New York firm represents hundreds of victims’ families, said attorneys would soon file papers at the Second U.S. Circuit Court of Appeals in New York seeking to reinstate Saudi Arabia as a defendant in lawsuits filed shortly after the 2001 terrorist attacks and consolidated in the New York-based federal court.

    “If we haven’t done it by today, we’ll do it Monday,” Mr. Kreindler said in an interview.

    Congress enacted the Justice Against Sponsors of Terrorism Act on Wednesday, overriding President Barack Obama’s veto, to expose foreign governments to lawsuits over allegations that their officials supported terrorist acts on U.S. soil.

    They admitted to basically not reading jackshit and want to "fix" the bill now. When you not only have the President, his cabinet and top pentagon officials telling you NOT to pass a bill with worries of disrupting national security as well as putting foreign relations in jeopardy, don't pass the fucking bill. >_> The one time Congress decides to actually do something for the people, ends up being a fucked up one.

    I don't know, when everything is about making and holding money and all of a sudden set a precedent for lawsuits that can take from assets overseas is a little surprising. Not to mention Congress coming together for an override and immediately regretting it the next day.
