Also need to understand that SCOTUS isn’t the legislative branch. Congress is. Congress isn’t passing anti-abortion legislation. That’ll be on the states with gerrymandered supermajorities. Still, it’s not getting overturned. It took what, 75 years to repudiate Korematsu, and that wasn’t a politically and culturally devisive issue.

Democrats Must Stop Pretending the Supreme Court Is Apolitical

Jon Green, a co-founder of Data for Progress, studied tens of thousands of newsletters sent by members of Congress since mid-2009, which were compiled by political scientist Lindsey Cormack. “Democrats are less likely to mention the Supreme Court than Republicans. And when they do mention the Court, it is more often to celebrate liberal decisions than it is to alert their subscribers when the Court has sided with conservatives,” Green said. “If this pattern is consistent across other channels of communication between the party and its voters, it could contribute to a misperception of the Court’s ideological alignment among the Democratic base.”

Look, Kennedy retiring is fucking awful. But until diabeetus gets Sotomayor, RBG finally loses to Death, or Breyer falls down a flight of stairs, Roberts isn’t going to let his reputation leading the court burn the country to the ground.

I mean I think less than 10% of the population can name more than one Justice, and you want the Dems to try get them to learn the ideological split?

The Dems tried to make an issue out of McConnell cock-blocking Obama, but the problem Dems perpetually face is getting their non-voters to care. They just don't. Even when we tell them why it should matter -- their unions, their ability to join class actions, etc. -- they don't.

We might win an election by promising a lot of free shit, but when we can't deliver the disenfranchised will go straight back to not-voting and become more recalcitrant about how nothing matters and how DeMs aNd RePuBlIcAnS aRe ThE sAmE"

I don’t think democrats have had a Chief Justice since the 50s. Or a majority of dem appointees in decades. It’s cool to turn this into a base movement for November, but it’s gonna be ok.

So is your opinion that democrats should just be civil about this and not make it an issue.

I'm not sure if activating Republicans about abortion is a good way to win back the Senate

i have no idea, i'm sure whatever McConnell does will be the correct thing to do because he's better at this than anyone else

Never said anything of the sort. They should make it an issue just like they did in 2016. I was more saying we're fucking boned. Sometimes all available moves result in a loss.

I mean look, the nuclear option is to pack the Court next time we get a Dem President. I'm not going to hand-wring about shattering precedent and norms because have no doubt in my mind that the second the Dems got a 5-4 majority that the next Republican President would expand to 11 Justices.

But that's not a long term solution. It just turns SCOTUS into another battlefield of alternating red and blue every 4/8 years as SCOTUS seat membership becomes a less exclusive resume title than than former staffer in the Trump administration.

I think it’ll be just as much an activation for dems, who actually started deciding that judicial appointments mattered about 2 years ago.

Moreover, I think itll help house democrats, many who need a lot of suburban women to vote dem to flip red house seats.

I don’t even know how to predict the senate. It’s an uphill climb, but what’s McCain gonna do. In July it’ll be a year since his glio diagnosis. The two year survival rate is like 30%. He doesn’t seem to want to give up his seat. What’s he gonna do with the confirmation? There’s also two pro-choice women in the republican caucus.
