It's morally scummy no doubt, but I think that it's far short of anything we'd want to try legally enforce.

There's a fine line about what sorts of lies constitute fraud in fraudulent consent. Things like fake offers of exchange (quid pro quo), misrepresentation of identity, etc. are a far cry from being misleading about long term relationship potential.

You can't really. You also can't really prove consent a lot of the time. As far as I can look up assault by deception has only been tested on things like condom usage and identity outside of Israel. As Gred mentioned it's a fine line but it's a very small leap from things like race, profession or in particular availability for a relationship to things like well wanting one. One which I'm sure is being pushed


For example Sabbar Kashur, 30, had consensual sex with a woman after he posed as a Jewish bachelor interested in a long-term relationship. While this one does seem to center more around race other articles suggest the decision was made about being a bachelor open to an actual relationship as opposed to married.

High Court Justice Elyakim Rubinstein said a conviction of rape should be imposed any time a "person does not tell the truth regarding critical matters to a reasonable woman, and as a result of misrepresentation she has sexual relations with him."

Rubinstein said the question was also whether an ordinary person would expect such a woman to have sex with a man without the false identity he created.
