Uh... dude was released because the judge didn't have dude's record of not just drugs, but convictions for domestic abuse, kidnapping, and shooting a man in the head. This ain't just someone in for crack possession.

I think it's kind of messed up that he was released and then yanked back in, but this ain't a dude who was just in for drug possession, and he's sure as hell not a non-violent offender. I think his sentence should probably be commuted at this point-- definitely not pardoned. When the system screws up, that's kind of on us to eat. Released-and-pulled back seems cruel and unusual. And he certainly seems rehabilitated, or at least not a threat to society.

But can we at least not make it out like this is Trump undoing the good works of Obama against a dude who did nothing seriously wrong?

That's an excellent question, and I don't know entirely. If it's not commutable by Trump, then Tennessee's governor should commute it. I don't think he should be pardoned, but his sentence should absolutely be commuted by whoever can make such things happen. I would be fine with it being a judge who calls it cruel and unusual to throw the guy back in for a mistake that the government made, just to give precedence so that it doesn't happen again (as long as that happens quickly). Unless there's more to the story of the guy being violent since he got out (which I've seen no indication of, and have seen a lot of indication that he has NOT been anything but a model citizen), I see absolutely no reason for him to be sent back to prison.

To be clear: he's *NOT* back in prison because of changed federal guidelines on drug sentencing. He's back in prison because his sentence was based on more than drugs, included numerous violent offenses, and his sentence was illegally reduced by a Tennessee judge (the judge who released Charles has said as much), who did not have Charles' full convictions before him when he made the ruling to release him. This is a case of a court screwing up badly, and then the state AG realizing it and going after the guy to undo the court's screw-up.
