Eh, even NPR reports say that isn’t accurate, unless by “surrendering to a border agent” you mean prior to crossing. An inch across the border without a visa, regardless of what you then do, ask, or say to someone that catches you is still a misdemeanor. The only way to do an at-border asylum request (without a concurrent criminal charge) is to wait in line at the border office and follow official procedure.

I wouldn’t call that surrendering though, since that’s the legal way.

CBP or whichever agency in charge has been preventing people from presenting themselves for asylum, turning them away multiple times. So of course they're stuck waiting at a border shelter (if they're lucky) while continually trying to present themselves for asylum, or else they are forced to try crossing somewhere else since many of these people can't just hang out at the border indefinitely.

Honestly, if you listen to the way Trump and Nielsen have been talking the past few days, it sounds like Trump threw a tantrum over our asylum laws and had Sessions concoct a scheme that tries to get around that, and the plan is to hold the children hostage in order to get Democrats to agree to changing legal immigration laws to either allow holding of children indefinitely with the parents or to allow for deportation of asylum seekers who do not have their cases authenticated within 2 weeks (which is unrealistic).

It's an incredibly sick policy.
