    It seems less to do with cyclist and more to do with giving cars special rules. From what I've seen a lot of places give the same exemptions for hitting pedestrians too. See some arguments saying why would we make ordinary bad driving crime...

    oh I'd certainly go and give a statement but they flat out say they can't file an actual report

    Right but I'm saying best practice is to call them when it happens for a report and statement. I assume you're saying they can't file a report after the fact

    Yes. But no I'm not saying that.

    Pretty sure I've clearly saying it multiple times but I guess it's something that sounds too dumb to be true. According to some googling and the police they can't file a report because merely hitting someone is not a crime to report. As soon as they remained to give info it became a civil matter and treated the same as if you got into a minor fender bender between 2 cars. Now if they fled yes they fully recommended getting a cop down there and even gave me a number for the specific division that would handle that unless major then obviously 911.

    You might be confusing criminal liability, and civil liability. Hitting someone with a vehicle, assuming you dont flee the scene or cause extreme harm, is a civil issue to be settled in civil court not criminal court.
    This makes sense, I dont want criminal courts clogged up with traffic cases because accidents just happen. Now if you make the conscious decision to flee after you hit someone, that's a crime and now you've upgraded to criminal court. If you were negligent in your driving (or in some states negligent with the maintenance on your car) and cause massive bodily harm then you get upgraded to criminal court too.

    But accident type shit? Nah why go to criminal court where you expect jail sentences to go down when all you want is money to be paid from one party to another, all of which can be done quicker and easier in civil court.

    Yeah. The point I was trying to make is that whether the bike accident is a criminal or civil matter, you want the police to write a report immediately and get your statement. Next step is to call a lawyer.

    I'm parroting what the Googles are telling me since I haven't been in this position yet.

    Picked some chuck roast on sale so decided to make some Mississippi pot roast in my pressure cooker. Everything seems fine but noticed it didn’t come to pressure. I turn it off and slowly remove the lid once I confirm it’s not pressurized. Turns out I forgot Hubby cleaned it last and took the interior part that helps pressurize from the lid off to clean it and I forgot to put it on. Thankfully caught it early enough but I feel stupid.

    yeah basically what I was trying to say... it's a civil issue is what they telling me.

    problem is though most cases you wont even get your money back and insurance will try to weasel out a not insignificant amount of time and well the number of times that this isn't an accident that just happened to happen. I've watched people stare at me while driving straight at me. I've heard people speed up behind me so they could get there front all of a foot in front of me before they made a right turn into me... over 3/4s of the way thru the intersection where the right turn lane is to the right of the bike lane or run stop signs/lights. There's a difference between an accident that happens an driving reckless/ignoring the rules of the road designed to minimize accidents.

    I'm just parroting what I was told at the police station. They said they couldn't unless they it was criminal. Now if there was an actual accident scene and I could actually get an officer down there to verify it and it was well verifiable then they could write an accident report which can help (or hurt if you in the wrong) when determining liability. Also in terms of liability at least in California you pretty much have to be 100% following the rules of the road (at least at time of accident) except obvious exceptions as well as some additions for bikes even if the other person wasn't either. I'm also told by local traffic cops that it's pretty hard to "prove" people broke traffic laws as video and non police eye witness statements aren't enough which can make proving civil liability difficult

    So we've been having some trouble with one of our trucks at work for well like a year now. Basically our trucks use a pto to power the machinery. There are tons of electronics to make sure not to engage that and the truck drive train at the same time and it started getting stuck in one or the other making it so we couldn't do work or drive. Months of trouble shooting and finally it just gets stuck for good. 3 more months of it just sitting the shop getting troubleshot and they have no idea why and just decide to completely replace the transmission hoping that might work. It seems to work and we get the truck back... and like 2 days later nope. Months of work and tons of money and parts and both the repair shop and the people who made the truck into what is now and none of them have a clue why it wont work.

    Of course as soon as we got the truck back "fixed" the boss immediately overloaded some of our runs with last minute additions because he can't tell people they have to wait a couple days when we have lighter schedules making it so we'd have to send all trucks out.... and I'm just shooting him the biggest I told you so look.

    Coworker went out on medical friday. Passed away last night from Cancer. Diagnosed with breast cancer a year ago, and despite a mastectomy and chemo, it was too aggressive, spread and took her. So yeah obligatory fuck cancer from me for today.

    So apparently Caltrans has shut down part of a highway which is the main route we were taking for our farthest away town we service. Told us it wouldn't be open till the tide goes down around 1pm +. There is no sign of this being closed until right where it is when the last turn off for this highway is literally 20 miles back.

    Boss immediately decides to have everyone come back instead of at least trying to go around and do half the run and now is running around trying to figure out how to put it on another day which is impossible with it being full but still insisting doing some was pointless lol. Sure it would've taken a good 2 hours to go back around (though just that one way since it's our normal way back but it's 2-3 hour trip out there anyways

    Posting here more so for visibility. I'm at work. I do insurance. Phone rings. "ACME Insurance, Kalmado speaking how can I help you?" Flipping political call for donations. Now look, I'm not political. I don't get into that stuff. But this guy was saying some vile things, and it absolutely was scripted. "Help the republicans keep control away from the democrats who only want to see America burn". Stuff like that. I tried to get a quote out of him but he'd then try to re-close me on the donation! In the end he didn't want a quote so I had to let him go.

    Good friend of mine I'm beginning to think is losing herself in religion in a way that's not healthy. 2 years ago she was pissed at her husband because he outright forbid her from taking her dream job working part time as a park ranger in a local park. His family follows the catholic teachings very strictly and even they were adamant she is not allowed to work, that it would emasculate him as it would make him think he's not providing enough (he's in the navy) and she caved. Since then it's been a slow decay into how woman belong at home raising the children and being home makers ensuring dinner is ready for him, etc etc etc. Her latest now is how the new Gilette ad is an attack against all men and they should be allowed to act however they want because if they love you they won't hurt you and it lets them get their emotions out.
