I don't recall some major split in the SC while growing up, always 4-4 with a someone who plays both sides or at worst 5-4. Was that not the case?

There should be a rule, or perhaps a law that forces the SC to have a fair/even split with the Justices. The Supreme Court should vote on it.

There cannot be a fair/even split of justices because (literally until this president) we all pretended that the supreme court was not a political body. Declaring them explicitly partisan indicates they are no longer unbiased judges and invalidates our judicial system.

Even if it they nominally were political and regardless all the shit we give 3P voters, the political parties are not officially fixed. Do Republicans still get half the supreme court if their voter base splits and forms a new party named Cux5Justice?

The answer is the unsatisfying “it depends.” There are Democrats already gearing up saying that if the GOP rushes through a nominee that the democrats have a moral obligation to pack the courts should they win.

The problem is the Democrats have been milquetoast politicians for so long that it’s hard to believe they’ll be as aggressive as we want them to. Nancy Pelosi is an effective Speaker (sometimes) but I do honestly think we need a new, more aggressive Democratic house leader. It’s no longer enough to sometimes be an effective house speaker. Also, a lot of these senior Democrats are too gullible. Like Hillary they would rather fallback and apologize when accused of something that is clearly bullshit.

For now, we should be laser focused on winning the election. Once were positive the Dems have won, then we move on to how to bully them to get our scalps.
