I'm going to continue to say it, Third Party votes only hurt if they are taking from your side. Republicans voting Libertarians don't hurt Democrats, it helps them.

Our constitution was always this flawed, but the confused ideology of the post civil war political parties obscured some of the flaws (and the ones it didn't obscure were used to keep black people oppressed so noone in power cared) until the 1990s, when the parties became ideologically coherent. No more southern segregationist democrats, no more pro-business but anti-racism northern Republicans.

Now that the incentives are aligned, all the exploits of our constitution (impeachment rules, senate apportionment, gerrymandering, money is speech, partisan courts with lifetime appointments, etc) no longer have a reason not to be used to the fullest.

I am on board with whatever radical change to the federal courts is necessary to deal with the crises of the day.

I would rewrite a substantial portion of the constitution if given the opportunity. Some of it would probably be worse, but I would bet that most of it would be better.
