I can't seem to find Kentucky's cap, so they may not have one, but many (if not all) states have a suspension cap where schools are penalized if suspending over X amount.
Granted, this is a private school, but the point is in general states are working hard to reduce suspensions as they are not effective. Usually suspensions are reserved for things like drug sales and violence. Not being an idiot at an event.
I also want to remind everyone the tomahawk chop part, while bad, happens for about 3 seconds in an incident that was about an hour long (if you count both the Black Isrealites and Native American incidents), and the kid stopped when he noticed no one else was doing it. I think that alone taught him it wasn't ok. As for the chant, it happened for a few seconds longer, but even then the kids seem to get into it and start singing with the drum pattern. It doesn't look like they were mocking, just trying to have a good time in what seems like a really fucking weird situation to be in.
