I think it depends on the states brother. I know in mine they take blood, no more breathalyzers . And if you refuse to have the blood drawn you lose your license for a year no matter wat (TN reporting, this is eye witness news)

I got the trifecta of possession of a controlled substance, possession of paraphernalia, and driving under the influence of drugs for traveling with weed in Oklahoma. No blood test or anything; it just comes as a package deal apparently. Police report just said dilated pupils. Nigga it was midnight. I have totes driven baked though in my younger days and once came to a stop at a flashing yellow light.

After much money, time, and some community service all charges were dismissed and the record expunged.. which was a pain to complete myself because my lawyer had to go off and fucking die in a car crash during my deferred sentence. I have no idea if alcohol was involved.

I've known 4 people who've died in single-car crashes driving drunk (one on his 21st birthday after he won a skirmish taking his keys back from friends) and had a good friend killed by a drunk driver at 7pm on a Monday.

A warrant is required to draw blood without the consent. I learned this from medical dramas where the drunk that caused the accident was in a coma and couldn’t consent and the cops wanted a blood sample but the doctors were all YOU CAN’T VIOLATE HIS RIGHTS and they had to go get a warrant.
