there's a chain of 50 or so all-you-can-eat chinese buffets here in ontario called the mandarin. they have a roster of about 5000 employees made up of 100% asians.

it's perfectly fine. they just can't have that shit written in print

The answer to the legality of almost anything is "it depends" and under certain conditions I could definitely win a lawsuit against them on this.

There was a lawsuit against Hooters that should have succeeded legally speaking, but the intense negative PR pushback is what led the EEOC to drop the case.

Regarding Chinese restaurants, there was a similar lawsuit already. If the restaurant is proven to be screening for Asian applicants only, it is 100% illegal. If the restaurant's methods of recruitment coincidentally result in in disproportionately Asian employees it is legal (in this case, the factory did not ever publish job openings, it relied exclusively on referrals of current employees, and that was held to be legal)

It is also illegal to impose restrictions that benefit Asians. A boba place was guilty of employment discrimination when a white girl asked for an application, they gave her one in Chinese, then she asked for one in English and they refused (because they didn't have one)

So yes, if I could prove that this place was tossing applications because the name was white? 100% I win this lawsuit.
