    Copyright protection for Steamboat Willie finally ends on January 1st. Disney, which has mined the public domain for a century while keeping its own works from becoming public for just as long, will finally lose control over one of its works.

    Keep in mind this applies ONLY to the appearance and characteristics of Mickey Mouse as he appears in the 1928 cartoon.

    Yeah they’ve been challenging public domain laws for a bit and have been unsuccessful. Winnie The Pooh entered public domain not long ago and people immediately made a Pooh slasher flick horror movie

    I remember actually studying this in both copyright class and trademark class. The way copyright works is that it protects the expression, not the concept. Like you can't copyright the idea of an orphaned wizard who goes to a school to learn magic. However, if you named that wizard Larry Gardener and had him going to Pigworts to fight Tim Reddle's evil persona Lord Voldemert then you're probably infringing on the expression.

    That's why characters can't be copyrighted separately from works they appear in because the work determines the expression but absent that, the character is just an idea. Sequels are protected as derivative works, which have their own copyright, which is how the author gets to keep using their creations but no one else does.

    This is the first time we've had such a major character enter the public domain though so the boundary of what is a unique expression of Mickey Mouse and what infringes on Disney's is going to be novel before the courts.

    Disney pivoted in the last ten years to arguing that its characters are trademarks of its company because trademarks don't expire, and arguing that allowing the proliferation of public work derivative characters would ruin their brand name and image.

    Wouldn't the definition of a "mark" mean that Disney's team would have to argue every individual cel of Mickey's animation is used by them in the course of trade? You can trademark the big-smiling Mickey face they used to use in front of his cartoons, or the 3-circle logo for Disney, but arguing an animated character is a "trademark" seems to unbelievably stretch the bounds of the concept.

    Yes, they have not been too successful with this argument. There's some valid logic in the idea, but the problem is that trademarks have to be very specific and changes to trademarks have to be registered separately (i.e. when a company updates its logo).

    I could perhaps see the argument that very flexibly a trademark might apply to a range of different representations of the same character in the same style, but they would still have to have multiple trademarks. Like a trademark for the "look" of Mickey in the Fantasia era vs. a trademark for the look of Mickey in the 90s vs. a trademark for the look of the real life mannequin actor costumes...

    I think that for most people pho and ramen (tonkotsu) are the favorites, but imo don't sleep on Thai boat noodle soup or soondoobu.

    I can't think of really good soup outside Asian cuisine besides clam chowder and menudo.

    to each their own enjoy ya life but it never fails to shock and disappoint how many adults go through life with palates that are little developed beyond their childhood favorites

    yall ain't too bad as most of ya grew up a little, ethnicy, and some folk never get beyond grilled cheeses and hot dogs, but damn my life would be emptier for not being able to enjoy a fat bowl of oxtail and smoked pork borscht in Winter time

    I don't mind a good meat based stew, and it's one of my go to lazy everything into the Instant Pot meals, but they aren't anything too special imo.

    That being said if I had to pick a red meat soup, I'd go with Irish lamb stew over pork and beef. I make mine with a bit of Guinness to make it extra hearty.

    I asked about Asian soups in particular because I feel like Asian cuisines have a higher priority in creating unique flavor profiles in soups beyond the protein. Probably because the noodles are the majority of the dish and meant to be a vehicle for the soup.
