I think that prosecuting Trump for anything and everything is a fool's errand. There's likely to be a hung jury because you'll get at least one Republican on the jury and Trump and the GOP will use it to cry witch hunt the entire time.

You go after Trump when you can use the courtroom to slam him in the court of public opinion by airing a bunch of dirty laundry.

Voir dire would be a nightmare already without the prosecution and defense arguing whether "Are you a registered Republican" should be a permissible screening question. And it would feed Trump's narrative about it being a witch hunt.
