    My understanding is that Reconcilliation and the Byrd Rule isn't some arbitrary law that the Supreme Court can't touch because the Senate makes it own rules, its a law and if they did that, they would have grounds to challenge and toss out the reconciliation build.

    The Byrd rule is not a law. The parlimentarian has been fired and replaced before specifically because the majority party disliked his rulings without triggering a Supreme Court challenge (in 2001)

    the constitutionality of reconciliation is dubious but then so is the filibuster itself. would set up a nice constitutional crisis should SCOTUS ever presume to dictate to Congress how it ought order itself.

    You know, it almost seems like the law and Senate procedure is a bit grey and there are multiple instances of precedent to justify such a plain act. Being unusual, but not unprecedented doesn't even mean I am being too hard on the Dems.

    Regardless, the idea that "who decides" whether a law passes the Byrd rule is in question when literally 100% of the time since 1990 it's been up to the Senate's own process is dubious.

    2. I didn't comment on IRA good or bad on the merits, I was responding to his stupid take it was bad because it could have been better if the Senate flouted procedure and norms to push something more radical. The mechanics of those processes are something that are very much exclusively the domain of legal specialists. I'm betting law librarians specifically.

    Spicy pretty much wants to blame the Dems for not being better regardless of whether being better is politically wise OR practically possible.

    Context: Alaska just switched to ranked choice voting. The candidates were Dem Peltola, an Alaskan native from an established Dem political family, Sarah Palin and Begich. Alaska is about an R+10 state, pretty high but not completely uncompetative. A lot of people there really hate Sarah Palin and seem to have voted for Peltola or chosen her as their second choice OVER Palin. Even her former in-laws campaigned against her. Dem momentum is here.
