Not really. If you hand me a gun, tell me it's unloaded and cold, and I point it at you and pull the trigger and wind up killing you, I'm still responsible for handling a firearm in a negligent way.
Will he go to prison over it? Probably not, but it's still a fair charge due to him improperly handling a gun, and hiring people who were unqualified to be an on-set armorer.
Reminder that "producer" credits given to actors are mostly a prestige thing and way to structure contracts, not because they are doing the day to day work of producing (hiring, managing schedules, etc)

Brandon Lee's death was a wholly different level of negligence to what happened here.
There was never a real round in the gun in the Lee shooting, as opposed to the guns for Rust being used at a shooting range on the same day they were to be used on set as prop guns.
Maybe there's something that hasn't been released yet but the picture so far looks like Baldwin was the poor soul who was given a loaded gun and told it was safe through multiple failed checks.
