Supreme Court could very easily sidestep the issue by ruling that (in contravention of established norms) the RNC and DNC aren't government entities and thus not bound by the Constitution in running their primaries. The issue would be moot until the general election, at which time SCOTUS could simply not take up the issue again until after November (and declare it moot again).
