Trump immunity case is being heard. I think the justices are signaling they may attempt to split the baby. I think the conservatives want to separate "official acts" from "unofficial acts" and allow for criminal immunity from official acts. Justice Brown got Trump's own attorney to blow a hold right through his own argument because she's a legitimately good jurist. Other conservatives didn't really care. Roberts actually seems to lean toward allowing for immunity for official acts.

However, even if they do grant immunity for "official acts", Trump's own attorney admitted in court today that some of the acts he's being prosecuted for are not "official acts", such as the call to GA Secretary of State Rafensburg, ordering him to find the votes.

But as Brown got Trump's attorney to admit, even official acts could be abused in a way that there would be no recourse for holding a president accountable. What if a president is impaired or compromised while performing official acts? This isn't a monarchy. Then, to entertain the official acts argument, if the president is impeached for an official act, can they prosecute criminally then?

They also brought up the hypothetical that if a President can only be prosecuted if they are impeached, what happens if a criminal act was found after the President is no longer serving and thus cannot be impeached, how do you prosecute? SCOTUS Justices are doing some media rounds and talks at circuit courts. In the last few weeks, it seems that several justices are begging someone to bring a civil forfeiture case up because all the liberals, Gorsuch, Thomas, and Kavanaugh have all expressed skepticism at how it's manifested and its violations of due process.
