It also won't be worth the hassle for the government to defend it in every circuit, especially as it gets easier and easier to win as more opinions get filed, and you know ACLU will be looking for these to file them up.

Is it plausible/possible for the legal system to like, have an appellate 3 judge panel or en banc sign off on nationwide injunctive relief or would that not work? The idea you gotta get people to join a class action to get status-quo relief is really insane. Especially when we're talking about prima facie unconstitutional BS here.

It won't blow up because SCOTUS applies the rules differently. Biden's DoJ asked the court to hear arguments about nationwide injunctions then. They didn't. They waited for Trump to get in office in his first year and use the DUMBEST FUCKING CASE EVER to hear the arguments. Then they gave him more power than they had already afforded him by stripping away one of few tools there are to fight back. And again, handed him this with 3.5 years left in his presidency.

For all the jockeying that Roberts is doing about the court being non-political, the rules absolutely change.

Yup, if we ever get a Dem in office again SCOTUS will just adjust their ruling or just 180 and rule against the Dem and everyone will be like "That's not fair....oh well *shrug*" and continue on like nothing

While the Supreme Court is rightfully catching heat for entertaining some of this administration's bullshit; in regards to the recent Supreme Court ruling, there is very important phrasing from Amy Coney Barrett in the syllabus of the ruling text. She did note affirmatively about the constitutional guarantee of birthright citizenship when she mentioned:

Here, prohibiting enforcement of the Executive Order against the child of an individual pregnant plaintiff will give that plaintiff complete relief: Her child will not be denied citizenship.

Despite her opposing views on allowing a nationwide injunction here, this signals the possibility of Amy Coney Barrett tipping her hand and saying when SCOTUS eventually gets to the issue of whether Donald Trump can alter the constitutional guarantee of birthright citizenship, they may actually very well rule against him.
