    There is a case being heard right now, being represented by the Trump admin, that would gut section 2 of the Voting Rights Act which is meant to protect against racially-motivated redistricting.

    The case arose from a challenge brought by white Louisianans to a remedial map the state legislature drew in 2024 that created a second Black majority district. The legislature drew that map in response to a district court ruling in Robinson v. Louisiana that the initial map adopted by the state in 2022 violated Section 2 of the Voting Rights Act, which prohibits voting practices or procedures that discriminate based on race, when it failed to draw a second district. The white Louisianans then challenged the new remedial map for discriminating against them, and a district court agreed.
    The admin's argument boils down to blacks overwhelmingly vote democrat and whites republican so their can't be any sort of discrimination when redrawing districts.

    Well, GOP states will have to start the process now and implement some kind of trigger law based on the decision, because that decision is not coming out til late June. Regardless, it's going to be a short turnaround from SCOTUS decision, voting on redrawn maps, getting it signed, have a primary, get your candidate, campaign, general election.

    4 months.

    With that said, if they do this, and it's blatantly obvious they rigged the election through partisan gerrymandering to the point that Dems will lose the house for a generation, Dems can get it back as soon as 2028.

    There would be only one remedy for this now. Or in 10 years. In 20 years. SCOTUS. 2028 Dem will have no choice but to expand. The GOP and Trump have pushed the country so far past norms, the argument to leverage that constituonal right bestowed to the executive is continuing to be made for a Dem president. Tit for tat.

    That is their only choice. If GOP has SCOTUS approval to gerrymabder, there's no other relief. State legislatures are gerrymandered to draw maps. You can rule forever if you get to pick your voters. Dems already need a +5ish% advantage to simply win a majority of seats. This would keep it out of reach for as long as they desire. Changing the law (which they won't do) or striking it down is the only choice.

    For what's it's worth, I think it's going to get gerrymandered bad for 2026 and I think the GOP will still lose. That will be their argument that the gerrymanders were overblown and justified....when they are down just 5 seats in a -7% environment. Incredulous, but that's gonna happen.

    Yeah I dont see the Dems losing the house next year even with severe gerrymandering. Important to remember that a gerrymandered district is no guarantee of success either Bachmann and a few others have famously lost in heavily gerrymandered districts.

    edit oh right it wasnt Bachmann that year it was another gop media darling at the time and she just almost lost that year.

    It had no standing. In the lower courts, the attorneys repeatedly argued that the case wasn’t about gay marriage but about her right to refuse based on religious freedom. It wasn’t until it reached higher courts that they tried to introduce the gay marriage angle, which isn’t allowed. This isn’t a victory for gay marriage—it’s simply how the court system operates.
