Gonna quote this in relation to the leaked document about Aerec taking large donations for Horizon, this is about sending a C&D notice.

IP stakeholders have to go through this legal process once they determine that someone else is using their IP to make money (doesn't matter if it is under the guise of donations) since failing to do so, could result in them losing those intellectual property rights, service/trade marks, copyrights.

Horizon is going out of its way to make sure it is very visible, in a way Square Enix cannot simply pretend to not see. If they cannot legally argue they didn't know about it, they literally have to take action on them because not doing so could lead to them losing the IP rights in future. Which does not just apply to FF11, but you could argue FF too. That this is a FF mmo raises the stakes for them.

For instance, if they ignore horizon making money from this and then in the future some chinese developer tries to blatantly launch a version of the game (mobile or otherwise) or some close knockoff, they could argue in court that because they did nothing about horizon they cannot legally stop this new game doing what they are doing.

Taking action on twitch streamers over streaming a PS is not just an action against a thing, it's an admittance of knowledge of thing. So by admitting they know, they are forcing other parts of the company to possibly take legal action too now in the coming months.

He's actually partially right, although not for the reasons that he seems convinced that he is. I had a lot of the same notions in my head before starting Wings as well, so before I actually went and did that I consulted with actual attorneys so that I could be confident that I wasn't stepping into any sort of legal grey areas. I had a lot to lose at that point in my life and I wasn't willing to put that at risk, but it was cool because I did learn a lot about how copyright laws in general work and that has been useful in other areas too.

People conflate running a private server to piracy, but here's the question: What specifically is being stolen? Nothing about LandSandBoat is proprietary to Square Enix, so that's not stolen. Anyone can go to the Final Fantasy XI website and download the game client completely free of charge, so that isn't being stolen either. It isn't piracy, so lets not even get caught up on that. Whether or not they're running a server or making money for it or whatever is completely irrelevant because at the end of the day you're allowed to make money for pretty much anything that isn't explicitly illegal, which running a copy of LandSandBoat is not. In fact, even doing what they're doing and intentionally making that backend software only use parts of the game client (aka emulating "era+" or whatever) is perfectly fine since you aren't actually doing anything that the game client wasn't already perfectly capable of doing.

So here's what IS proprietary to Square Enix: the client artistic assets. Things start becoming extremely muddy when it comes to modifications of the game client. (In other communities they sometimes refer to these as rom hacks.) This includes things like replacing the music, textures, data files, etc. Up until recently 99.9% of private servers weren't doing this, and I firmly believe that the reason they've actually taken notice lately is because of a combination of rampant advertising and the fact that the game client has been tampered with, because he's right that if they don't do something about that part of it there is a legitimate chance that someone could legally argue that they were not interested in protecting their intellectual property and risk someone doing exactly what you described. Especially when you start to consider the fact that they've been removing Square Enix's branding from the client in various places via dat mods.

I think if this were XIV they would have been significantly more aggressive in their approach to this, but given how in-your-face private servers have been about this sort of thing lately I am not surprised that they eventually awakened the beast.

It wasn't just my name shared. It was also my husband's which is not as widely known. As I said, my harasser now has his name, too. If a person requests their personally identifying information to not be shared, you should respect that. You don't understand how threats make someone feel. And you can't handle being told that you're wrong on this one, so that's why you lock everything down and delete posts from others who aren't on your side. Also noting the reason why my name is changed on BG forums is because of a stalking incident from FF14, and Sonomaa had to change it for me.

I have a harasser who already has my info and has been coming after me. But my husband's name was also shared in the reddit post. This was the issue. But any stranger on the internet shouldn't be dropping people's names anyway if it is requested to not be used. Spicy is just an idiot.

If you make a product that was made to have a repeating sub fee to access, that is full of IP, then someone hijacks that product (either via piracy or reverse engineering) and offers a competing service using your product then you are stealing the income from that service. Denial of revenue I think it's called isn't it? All they have to do is show that people are using it, because it's ff11. Which they are.

The thing is, they don't really have to win a legal case anyway do they? They can just threaten to bankrupt you with years of legal fees if they want to make a point, this is why most people fear a C&D order. Normally a company does not want to bother with this crap, but if you make them have to make an example or protect their IP they can do it easily.

Also if the person has some kind of good job, the employer will not want him being entangled in this kind of bad press and so again they can win without even winning in multiple ways. Their employer will tell them to shut it down or be fired if Square decide to go for it.

They usually don't even have a zero tolerance approach to this, they just make an example of the most prominent version of the thing to show they are protecting their IP. They would only go after Horizon for example, not the others.
