The birthright citizenship case is being argued right now. The birthright part of the case is actually the lesser argument and one I don't think anyone is buying.

The argument this case really sets up is universal injunctions by lower courts (such as when the Texas judge tried to ban Plan B pills nationwide). Kagan is hammering Sauer on the underlying merits, pretty much telling him she can't believe he had the audacity to bring this case.

The split looks like it should be fun. It's not a particularly partisan issue. Both sides abuse it and both sides hate it being abused. Right now, it's looking like Alito may join the liberals upholding UI, but ultimately will probably fall 5-4 or 6-3 if Alito is sandbagging.

Edit: There's A LOT of skepticism among the conservatives. Gorsuch pretty much deferred to Kagan. Barrett is eating Sauer. Sauer stated that they'd mostly follow lower court orders....Barrett, very politely, asked what the fuck he meant by that. She's calling out previous administrations, but specifically pointing at this administration's abuse of the courts.

A lot of justices want to also get to the bottom of the 14th amendment question and it is NOT going well for Sauer.

No, most certainly not. The Soliciter General (Sauer) really wanted to avoid the underlying argument and get to the question of universal injunctions.

When SCOTUS took this case, and the WH pushed for it, I was a bit shocked. It's a horrible case to use if you're the SG. The underlying merits are so fucking unconstitutional that the SG wants to avoid it. Sauer is pretty respected among the court and the justices tend to allow some deference to the SG. Not today though. He got beat to shit by both sides, while opposing counsel slayed. 2 conservatives justices didn't even ask questions of opposing counsel, which isn't good for the administration. They won't prevail on the underlying case of birthright citizenship. They may win to block UI. There's a lot of technical lifting to find a workable solution. I suspect they'll try to split the baby in some way. Congress has several proposals that could probably garner bipartisan support. I think most everyone agrees that wholesale blocking legislation, along with court shopping, is incredibly bad for the judiciary. At the same time, failing to grant relief to people who can't afford attorneys is incredibly bad. No one wants an absolute never or always in regards to lower courts issuing UIs.
