The memo, first reported by Axios, comes despite the Office of Personnel Management's own September guidance, which said federal workers will receive retroactive pay after the shutdown lifts.
The memo also clashes with a 2019 law that requires back pay for federal workers. The law, called the Government Employee Fair Treatment Act of 2019, says all federal employees, whether furloughed or deemed essential and working without pay, must receive back pay after a shutdown ends.
So legally they can't sell it to private lenders as that would be a violation of the terms of the agreement. Would he do it? Of course. Would it hold up in court? Absolutely not. There are people who have worked with student loans issues by the government who are frothing at the mouth for some unfortunate fuck to be dumb enough to do this.
The government can absolutely do it legally, all they have to do is consult with Treasury and get them to release an analysis that says it won’t lose any taxpayer money.
There’s no way that happens unless they lie or they thoroughly fuck over borrowers; knowing them they’ll do both.
