I agree with Zigma. It doesn't matter what state he is in when he pulls Tiamat, all that matters is that he won the claim. If he wins the claim, he certainly has the right to decide whether they are unable to fight. You really can't make that decision on his behalf. If you have an issue over whether or not he is in a state to fight/hold Tiamat, improve your pulling skills and there won't be any dispute - simple as that.
