This is, clearly, and I don't think NynJa would argue with me here, one of those situations. The guy was being belligerent, mouthing off, flailing around, resisting arrest.

HE WAS STILL IN HANDCUFFS. Stop tasing him. It's stupid.
Handcuffs dont prevent people from kicking around...

you try to carry a 200 pound person whos kicking and flailing around down couple stories of stairs.

if the guy were cooperaring, or atleast not being a complete fucking idiot, then yeah, I'd agree with you guys against the cops.

These are you rights unless a police officer has probable cause to search your car or cuff you. They don't advertise this, and after watching COPS and movies you wouldn't know this, but you can refuse to a search without a warrant from a court. At which point you all wait there while a judge draws up a warrant.

If you say no and a cop tazes you and forces you to, because you were exercise your rights? So he deserves it for harmlessly exercising his rights to speech?
Yeah, the problem here is that if a cop wants to search you, YOU DON'T KNOW if he has probable cause or not, and therefore your resistance is just like this guys. You think he's racially profiling you and therefore you resist, but he isn't and you get tased, OR, you think he doesn't have probable cause, but he does, and you get tased. It's basically the same thing.

However, hopefully once he tases you and handcuffs you, he stops tasing you because he feels like it.

This all comes back to the same thing:
You shouldnt be driving your car without your liscence to begin with...Just like this idiot shouldnt have been using school property without his ID.

Yeah, it would be really hard for me to do that by myself.

That's why there was 4 of them. Componded by the fact that tasing this guy didn't make him more complacent, it was a stupid thing to do. Tasing someone should have a purpose, and if the cops thought they had a reasonable expectation that it would make this guy, clearly whipped up into a "they racist!" discriminatory fury with a compassionate audience, who wasn't even kicking until they tased him the first time, stop doing so...they're stupid.

Don't get me wrong by the way; I'm not making this kid out to be a hero, I'm just saying the cops had no right to react the way they did, and that shit like this if left unchecked can lead to the eventual decline of freedoms we enjoy and take for granted.

I wouldn't have reacted that way, but they had no right to taze him, period.

Yeah, cops are to blame that we don't like getting caught violating the laws. Police my neighbors, just don't police me. If cops were as nice as people demand of them, there'd be no law anymore. It's not a "Customer is always right", it's "The police are always right." (I'd like to say as people become adults they mature into understanding this, but alas, half of todays adults are just a selfish as any teenager.)

While policemen abusing their power is an awful thing, I honestly don't see it here. Kid wasn't supposed to be there, continually resists the police officers when they arrive, and we're blaming the cops instead? I got fifty bucks that says the kid WANTED to keep getting tazed and look the victim. "Here's your abuse of power!" He was making a scene just like a 7 year old screaming bloody murder. If no one else were around, or the bystanders were yelling for the cops to get that asshole outta here already, our 'victim' would've been 99% less likely to make a scene.

Obeying the police isn't optional. Well technically you don't HAVE to obey them, but you get rewarded with a tazer until you do - as seen in this video. I see absolutely no problem with this. I hope he has good parents who whoop the living shit out of him after seeing this. I'd be dragging that kid down to the police station to personally apologize for his behavior, just like taking your 7-year old back to a store to return candy you found he'd stolen. Inexcusable behavior.
Sadly, the aftermath will probably be these police officers being reprimanded or fired because it's in the media and tons of kids crying. Now I ask you to think what this kid's behavior is going to be like the rest of his life. If he get aways with the last frontier, "Don't you fucking touch me" to police officers, I'm sure he'll be an even more wonderful member of society as life goes on. "Rules? Only cops have to follow rules."

Sorry dude still don't agree. That post is just as ignorant of our inherant rights in this nation as others are. We have a right to protest anything. He was non-violent, and non-violence does not mean it needs violent action to stop what someone in power to stop what they don't want to hear or deal with.

The problem with police is that they are human. They make errors of judgement just as much as the next person. A badge doesn't give you the power to control any situation in the way you see fit, it gives you the power to protect citizens with the guidelines provided to you by laws.

Actually with probable cause police can do just about anything they want.. its only AFTER the fact that a citizen has the right to go after the police for making an error.

Even if you are a criminal and in the wrong, you want to keep your mouth shut and cooperate as much as possible with he police.. its like the #1 rule they teach you.

Courts can settle any issues later.

So wait, the kid wasn't asking for it by screaming at the cops and not cooperating?

It was going to end badly for him due to the fact that he broke the rules of the university he attends. He's a senior. A senior. If he doesn't understand 'when you use the library after hours during exams week, you need your goddamned ID' then he must accept consequences. And then he had to go and scream at cops prior to any tasering. You understand at this point he's asking for something other than a polite 'sir leave the library now please.' from the authorities. It's not racial profiling. Nothing about him being Iranian forces him to ignore important campus security rules then scream at cops when he's caught breaking them.

4-5 taserings is excessive any way you slice it, but he was not Mohandas fucking Ghandi. He was a shithead breaking rules with a foul attitude and he was asking for everything he got. Repeatedly.

I don't know where you learned your law from, but I suggest cracking a book and turning the TV off. Cops CANNOT do just about anything they want. And you are not as a citizen expected to just have the right to complain after the fact.

This is why Miranda Rights are read before an arrest. Police do not have the right to coax statements out of you without representation. They cannot enter your house. They cannot search your car. Not unless they have probable cause, which must be proven in a court of law after the fact.

You have the right to refuse a search or arrest without warrant, the police may then DETAIN you, and hold you in the spot. You can shout, argue, disagree, do whatever you want as long as you do not threaten the officer or the public. It is not until then an officer can take physical action.

The mentality that police can do whatever they want is dangerous and discouraging for this country, and it is absolutley 100% not right.

I respect the fact that you all have and can share your opinions on the matter, but the fact of the matter is he will win a lawsuit or it will be settled for a large amount because of what happened.

He may have been in the wrong in his reaction, but the response to his actions was unwarranted and way overboard. He didn't deserve what happened to him any way you slice it. So he had a tantrum and expressed his view. He had no weapons or made any threats to officers.

The law is the law, and your opinion of people deserving to be beaten and tazed for making a scene of their views and exercising free speech is something that only makes society worse, not better or safer.

I know what I know from my family lawyers and the sheriff's department because I've been the target of corrupt police officers.

Police can coax statements out of you.. they just won't stand up in court. The can enter your house with probable cause. They can search your car with probable cause. The evidence may not stand up in court AFTER THE FACT because the probable cause was bogus, but corrupt police officers rarely care about making court cases and seek to intimidate their victims.

Probable cause.. Probable cause.. Probable cause. Procedure may vary state by state, but they have loop holes to do what they want.

blah blah. Look, you are right. However, if they police -say- they have a "probable cause" reason to search your car or house, then they for all intensive purposes -can- do so, and you don't get to decide on the spot if they -really do- have probable cause or not and get belligerent. Don't give people the idea they can realistically refuse police searches and expect them not to happen - the best you can do is state "I do not consent to this search without a warrant." and get out of the way until the court date if they find anything.

My lawyer told me something like.. "They may even take you off somewhere and drive around for awhile. If you wanna know what time it is.. The sun raises around 7 and goes down about 6. The only thing that ever comes out of your mouth is my name and phone number."

Hell, if the police fuck up your almost better off keeping quiet and letting them do it. Your lawyer will be all over that shit and make them look like jackasses later.

The pretext of having cehcks and balances isn't so that police or politicians can do what they want when they want and then pay the consequences later......

They are they to PREVENT things of this nature happening, and if it does happen they will determine who was in the wrong. If you tell a police officer not to touch you, that is your right. I know this argument is getting redundant and I see I am repeating myself so I'll just end it but, please don't be ignorant about your rights and the law and say people deserve to do shit because they took a 2 month course on law enforcement and some P.E. and have a badge to prove it.

    That's ricockulous.

And I don't know if Devek is from East Germany circa 1982 or something but, that's just plain retarded what you just said.

The thing I noticed and probably would justify in my mind tasing the guy was the ability to control the situation. For all you sea lawyers you should look that up. From what I understand when a situation deems a danger to a police officer, or innocent bystanders they are allowed to take action to immobolize and extract the person from the scene. The whole part where he started to try to get his fellow students involved to support his crusade could have became a dangerous situation. The student probably weighs anywhere from 170-200lbs or so. Any human being who weighs that much can resist arrest like a pro, which he seemed to be doing anyway. So to get the guy out of there so they didn't have a bunch of screaming yuppies pissed about how their rights are being trampled on they tased him. The other 48 taser charges probably should not have been used but w/e

Case and point: Young BLACK (yeah I said it) man is in walgreen's looking at cough syrup. Cashier asks for his ID he doesn't have it. They ask him to leave he refuses, cops come to remove the man. He resists and tells them "get your mother(*&^(* hands off me p.i.g.s. They handcuff him, he starts ressisting arrest and screaming about black power and the white man holding him down. They tase him to get him to stfu because there are 10 gang members outside the store that could easily hear this and create a protest situation. I think they are right to tase him and they were right to initially tase the student.

Also I have been tased 4 times in a 8 min span (1 tase per 2 min) and it mess' you up (its like someone stuck a hot pin in your leg)... but you can still stand up. Do not believe the hype that the guy just could not get up because that is ridiculous. The cops had their arms there to support his upper body making it even easier. The taser only immobolizes the section that is tazed and its for a short period. The other option would have been billy clubs
