I think the reason they're recalling these is that currently none of their games are going to have as in depth and reflexive commands as some of the upcoming games <_< probably just a preperation

To be anal about it this isn't strictly a recall. The U.S. Consumer Product Safety Commission is not involved and there have been no public safety advisories on the matter to my knowledge. This is a voluntary 'get a free replacement strap' program for people who swing their Wiis like samurai swords for the smallest thing. The strap is plenty strong as long as you follow manufacturers directions and don't let 7 or 95 year-olds play with them in an unsupervised environment.Originally Posted by Zalius

its simply preventative measures Nintendo is taking. It's cheap for them to do this recall in all honesty, straps don't cost much.

None of the games require any kind movements that would break the strap in the event of you losing grip. If your toddler almost chokes himself on a plastic bag/small toy that you give him to play with, is the manufacturer liable? No again.
Assuming all of the above have the proper warnings, then none of those situations would win a case for liability under normal circumstances.* The same is no different for Nintendo.
In order to be considered liable for something a few conditions have to be satisfied... First of all, the absense of a warning on the product that says using it in such a manner could be harmful. Second, is that the product has to hold an immediate and unreasonably high danger for its uses. The strap situation does not satisfy any of those conditions, and therefor it wouldn't win a case of liability under normal circumstances*.
*EDIT: I say normal circumstances because the judicial system isn't always so cut and dry to say doing xxx means yyy for all situations. In reality, despite what the law would say about them not being liable, if you make a good enough case the law is often bended just out of emotion/pitty/etc. I'm talking like, the Wii remote impaling grandpa the day before his 100th birthday and 50th anniversery on Christmas Eve in front of the entire family and causing the house to catch on fire and burn to the ground from the turkey burning in the oven due to the distraction, resulting in two dead cats and a chipmunk.
Its not that simple to compare those liability cases to Nintendos, they each have their own debate thats why they are in court lol.
I do agree with you in some sense, I don't find any of them to be honestly justifiable claims. But people will still file them, most of society is greedy.
I got the feeling you are and/or/were under the impression that Nintendo will have zero problems with this "wii strap liability" scenario.
On a side note I don't have the link handy but some company is sueing nintendo over their wiimote. Its not injury related it was something about the Wii mote Trigger, claiming copyright infringement or something.

Oh yeah, people will always file lawsuits regardless... I read about some really crazy ones, like this guy sueing for there not being a warning on his chainsaw that he can't stop the blade with his hands. Or, a more well-known one is the person that sued McDonald's for making them obese.
But like I said, sometimes you really can win weird cases like that if you make it good enough.
So yeah, they'll definitely get some trouble with people trying to sue, but in reality nearly all (if not all) of those cases won't hold up in court. Unless that whole grandpa thing happens or something like it.
I haven't heard of anyone actually trying to sue them yet though, has there been?
