Even still, the highest bidder still wins the gear. I see stuff happen all the time where some mage with a shelved Lv 75 melee job will bid shitpiles of his hoarded points on hot melee gear that never gets used. That's the kind of thing I'm talking about, and it happens in every end game shell on Titan.
IMO shell utility > individual e-peen
The alternative, where the event leader assigns people to lot(which is what I *think* BG does) is a better method I think, but it has its flaws too. The leadership has to be 100% impartial, and keep shell utility foremost in mind.

oddly enough, people join HNM linkshells for their own benefit too *ocassionally*. if the WHM75 has WAR75, why should they not be allowed to get a haidate? it could be their merit job or something. it's not all black and white.
If people in the shell are content with loot distribution and overall everyone's happy then that's their perrogative. Is it necessarily the most optimal way to distribute gear.. no, but then again I've yet to see a loot system that works perfectly without any drama. In the end this is why a lot of people burnout or choose social LS over end game LS.

In that order. It doesn't always work out that way I'm sad to say, but those are my priorities. Since I've been a member of Particle, I've gotten WAR v2 hands from Jeuno. That's it. That was months ago as well. I'm still waiting on haidates, and I will have to bid against a fucking RDM who never uses his NIN for LS events to get them, and who will probably outbid me as well. I come to events as WAR mostly, my WAR is *way* better geared than my WHM is, and therefore I bid on McRidills, E body's(which don't exist btw), and Haidates. I don't cockblock career mages just because I can. All that to say this Merona: I'm not saying the WHM with 75 WAR shouldn't be allowed to have Haidates. I'm saying that a career mage lotting rare gear for melee e-peen(lolmannequingear) is douchebaggery.

If those items being complained about going to the "wrong" job were going to make or break fights, then yes, people have a point over need vs greed on this gear.
Fact is, in this game, most gear is sidegrade or situational enough that there are usually decent enough alternatives and they will not cause you to win any single fight (or lose it by the wrong person having it). Can it make your fights more efficient? Sure. Can you win without them? Yes.
So anyway, if you've got a shell that spreads the wealth around to people that participate, even if them getting items isn't the most efficient use (they still use them, as opposed to rotting on a mannequin), what exactly is the problem?
