Some cultures relate family heirlooms as national treasures. Especially from families in seats of power. Given that this "sword" is used by the head of the family and for fighting gods, one could wager it be pretty valuable to the ruling gov't. Steal from the family is stealing from the nation.
I got to see another thing I wanted. Nano releasing her zanpakuto. Though it doesn't look like she knows how to use it. The backstory has been very interesting it's like Kubo learned how to write manga all of a sudden.
Because it belonged to her family, which is (was?) an important part of the soul society, as noble families often are in their places of residence. The family was required to pass down the sword to their descendants, and she purposefully bypassed that by unilaterally removing the sword from the family.

I don't see how it would be possible for her to Bankai. I'm not even sure how it would be possible for her to even Shikai since she's never seen or used the blade.
She can't, she never learned how to fill her sword with a spirit.
I'm assuming the sword is perpetually in that kind of state due to the whole origin of it belonging to the entire family rather than an individual.
