I was thinking about it, since Tousen's Zanpaktou seems to be the exception to the rule that they can't be used by the same person, isn't it possible that his only looks the same as his friend who died? It was never stated that he took her Zanpaktou, right? So it could be in shaping his Asauchi, he did so to make it look like hers. And we never saw her use it, so we don't know if she even had a Shikai. I doubt we'll get any real explanation since he's dead and all, but it might explain things~
