Well say I sent in my DS with a dead pixel, and they sent me a working one, but it had a big crack in the top screen. But they gave me a free Mario 64 DS. Same situation.

Still, $600 is still a pretty big investment on a video game console. Only to get one thats broken and then scratched is kind of annoying.

A cracked screen is reducing the visibility of gameplay. A scratch on a console will not make the console unplayable like a crack in a portable's screen will.
Nintendo has AMAZING customer service... I was thoroughly impressed when they offered to replace my broken remote FREE OF CHARGE (yes, including shipping) as long as I send back the broken one. The agents there aren't all pissed off you're calling about your Wii (since those calls are pretty much all they answer now-a-days), which just brightens up your day as it is. Shipping was prompt, and actually replacing that shit was just plain awesome.
Your unit has an issue displaying video.
It got put into the stack of PS3s to be repaired.
To make sure that you get yours within 2-3 weeks as opposed to 2-3 months, they send you the next-available working PS3.
You get it, and it has a scratch, but the Game Playing Unit Plays Games.
They wipe their hands, smile, and head off to an early lunch.
Also if you sent it anywhere but Japan, then they almost definitely won't repair it, They'll ship it to Japan, and when the next stack of Refurbished and Tested Working units.
