I believe the way it works is that the full 9-tails of power can come out, but releasing the seal would essentially break the Kyuubi free, meaning there is a level above "9".

In the original version, it's a "9" - BUT you can tell it's fading in (as it's faded out) so it's not exactly nine yet. Also, you could see Naruto beginning to peel off the seal as this is happening.

Yeah i am sure thats what it means too.
I am sure Pein and/or Konan will die in this arc too. there isnt really much left for them to do. and that would leave Tobi with the 7 other beasts that are captured (im certain something will happen with them
