Either he released the seal, re-cast it as he was fading away (because he -WAS- fading away, which means that the jutsu -WAS- wearing off for a moment), or just broke the galaxy.

My issue is that wasn't it niidaime hokage that invented it? I thought Shodai killed Madara, which would possibly/probably place Madara as already dead when Niidaime invented it, unless Niidaime invented it while Shodai and Madara were still battling, or even prior to that.

When would madara have had a chance to witness and copy that jutsu? Did he watch from beyond the grave? It wasn't like Kabuto summoned him prior to this, because he doesn't even know who the summoner is. I'm actually confused this time.

I don't think the second hokage was hokage very long. Everytime they've shown him whether it was while the 1st was around, or when the 2nd was about to die and the 3rd took over, he looked exactly the same. Odds are Madara saw him use this prior to his fight with the first, they were technically allies up till then, weren't they?

The 2nd doesn't want to destroy the world and he didn't have any free will when Orochimaru summoned him. He couldn't have made the decision like Madara did.
