Homeowner had 'a right to resist'

    http://www.heraldtribune.com/apps/pb...NEWS/703140547

I agree that the guy and his wife should have just cooperated with the police however I am glad he got acquitted for putting the beatdown on two deputies who were breaking the law themselves.

I see too many videos lately where cops and security guards are pretty liberal with their taser and authority. Those cops weren't even there to arrest the guy, just to serve him papers. Nice to see some payback for not respecting Constitutional rights.

John Coffin won't spend any more time in jail for beating up two sheriff's deputies inside his house, striking one in the head with a Taser gun he took from the other.
That is the funniest shit I've ever heard.

cops need to realize just because they uphold the law doesn't mean they are above the law.

He did Taze the cop either, he smacked 'em til they passed out.

Does this mean the charge of "resisting arrest" could be found unconstitutional if it went through the proper channels?

He was still charged with the 6th charge, but it seems he got off after having already spent 8 days in jail. Does that still make him a felon?

He pleaded no contest and was given probation (which he already served, 8 days in jail).

Doubt its going down on his record as a felony.

And it's stories like this that hopefully brings them down to reality.

I am pretty sure the charge he pleaded no contest to was a misdemeanor. The charge is cited as "taking a Taser gun from one of the deputies", probably some deprivation of personal property law rather than a violence charge.

Actually I think that falls under a felony of disarming/stealing a weapon from a cop.

A Tazer is probably not considered a "lethal" weapon, hence the reduced charge.

Pretty certain taking even a billy club or mace from a cop is a felony.

Because you have to bludgeon someone with a billy club to get them to give up coming at you, and with varying levels of pain tolerance among individuals, you can cause lasting damage.

With a Tazer, all you have to do is press a button and they go down in a non-lethal format. Pretty sure mace is in here too.

But Coffin, 56, had a right to defend his family and property because the deputies had no right to be in Coffin's house in the first place, De Furia said.
Who says 40 is over the hill? Way to go dude.

can the homeowner argue on the ground that he didnt know whether they were really police officers or not? i mean police costumes aren't hard to come by. plus, isn't taking intruders' weapons part of self-defense? neutralizing an imminent threat? otherwise, he would have been put down like a stroke victim.

he could have, probably, but he pleaded no-contest instead.

such a shame. he's now a convicted felony because he legally defended his home and property, while those cops who broke the law are probably on paid vacation.
