I just think theres a difference between saying something like, "hey dude, yeah, see those lights, god they make me wanna kill people" vs. "hey dude, yeah, these voices in my head keep telling me to kill people."
I'd let the first comment go, I'd report the second.

The premise of Minority Report relied on prescience, not telepathy. So you would have to actually do it in the future to get that guy to show up. Not to mention you'd have to be in DC. And if the crime in question is related to terrorism, I'm pretty sure you can get arrested and put away forever for "planning" something. Normal crimes are different, of course.
As for the sarcasm question, that's where you have to take into account the way he said it, not to mention his exact wording (which may or may not be accurately reflected in the quote). I definately wouldn't put it past an American to fail to catch sarcasm and have someone crucified for it.
