FUCK - I just wrecked my car :<

So I'm driving to work this morning and there are two lanes, Im driving in the left lane. A guy goes to make a left hand turn into a shopping mall and there is no turn lane there, so he has to stay in the left turn lane to turn. I was tail gating him (He was doing 35 on a 50 mph road - -b) and he slammed on his breaks to make his turn. Doing this made me swerve a little bit on the checked line. The right lane was ending right at this turn, so alot of people were merging around us. A motorcycle out of FUCKING NO WERE comes up and sideswipes my car. He took out the entire right side of my car. I have a 500$ deductible to pay, and I was "At fault" for some fucking reason and I gotta pay this guy's insurance shit because my insurance company decided not to cover this, at all. He had to go to the ER because he was bleeding really really badly. I have 1,000$ in car repairs, the entire right side of my car is fucked, I have to pay his 500$ shit, and I know hes going to sue me for loss of work and what the fuck ever.

I have a guaranteed 2,000 USD bill right now and im sure this guy is going to hit me up for more money, what do I do

If your insurance company isn't a group of douchebags, they'll do anything they can to keep you out of the courtroom. I wouldn't be too worried about that. Make sure your insurance company puts at least SOME liability on the motorcycle driver. The laws are different in each state, but you can almost find SOME reason to place at least a little bit of liability on the other driver. What state do you live in?

Dang that's shitty. You were sorta screwed either way since I believe every state has a law saying if you rear end someone its your fault regardless.

Best shot is to spend another 2g's on a good ( evil ) lawyer and wish for the best. Also ask for the motorcyclists blood work for alcohol or drugs, then you can turn the tables and sue him.

What state do you live in? Do you hit the guy in front of you? Did the motorcycle guy basically hit you from behind/come up from behind hit you and mess the side up?

I know in NJ where I live if you hit someone from behind it's there fault. So if you didn't hit the guy in front of you and the motorcyclist came from behind when he hit you, he should really be at fault. I would recommend getting a lawyer personally and find out what exactly can be done.

I would think too if the motorcyclist was speeding(coming out of nowhere) then you can use that against him if he trys to press charges. Speeding and hitting you from behind would make it his fault, or at least in NJ it would.

He didn't rear end anyone, he swerved to avoid a rear end and got sideswiped. At least thats what I understand. Depending on where your car got hit, which you said in the middle, thats PLENTY of time for a cyclist to respond and swerve to the side. They'll place some liability on the cycle driver if they're good claim reps.

My insurance company is not helping me at all. Unbeknown to me, I am currently on my mothers plan( I knew this part ) but she had the car in her name and did not register me under a driver. They flat up said "You're fucked." (Srsly.) I never hit anyone, the guy hit me. I am going to go to my uncles house and barrow his digital camera tomorrow and I'll post some pictures. I drive a 4door, he hit me in the middle of my back door ALLLLLL the way froward. I mean I am glad the guy didn't die but fucking A man. My ticket they gave me says "improper usage of lanes" for swerving. I was at a complete stop when hit. so its not like I pulled out in front of this guy.

Im shitting bricks right now and srsly stressing out. Thank you for the quick replys. I have never even been pulled over let alone got into a wreck so honestly I have no idea what to do. I have about 400$ right now to my name, so getting a layer is really out of the question. I dont want to put myself in more debt.

The thing is tho the guy didnt bitch that we wrecked, he drove a real beater, something from the 70s. It wasnt in bad but it wasnt great. He knows hes getting a new bike. The only thing he said to me was "Hey, can you please get this bike off me, this thing really hurts"

The way I understand it is you were tailgaiting someone (not legal.) then you swerved into the other lane to avoid said someone (im guessing without a blinker, so not legal and is considered reckless driving) then because you swerved into the other lane you went right in the way of a motorcycle not expecting your swerve.

I'm at fault in the sense I was being an asshole driver, but I was stopped for a GOOD 30 seconds. Its not like I jumped out infront of the guy on the fucking motercycle and was like WAH IN YO LANE Here is a diagram because you cant figure out what im saying (No doubt because you want to try to be an asshole.)

The problem is, you were tailgating someone around the time of the accident, so techincally you were breaking the law. (Yes, tailgating is illegal, sadly). Violating any form of traffic law while being involved in a collision = you automatically at fault.
