Just reread everything...and realized how immature alot of people on BG forums are, honestly to say "lol" and "this is funny" ; if anything this is pathetic, when going over it again, it was an old man...and I would assume you are late teens, early twenties, so wtf would you even push him? Where you really threatened by an old man that you had to push him down some stairs?

If anything, I would lol at your stupidity, and take back my statement that I hope nothing bad happens to you, anything that the school, the old man, and possibly any law enforcement would do to you, you deserve it for your actions in the incident. (my grandfather did die from someone pushing him down some stairs seven years ago, so yeah, really its stupid not funny)

This has nothing to do with your fucking grandfather. This has to do with some crazed fucker chasing me down, almost hitting my car and me as well, then attacking me while completely unprovoked.

It would be one thing if he was an old man with a cane and was obviously decrepid and frail. He was not. This guy was probably in his late 40's or early 50's. He looked like a dad with white hair. He was completely physically capable. He did pose a threat because he was, a) flustered, b) physically fit, c) furious, and d) violent.

Did he really hit me off of this staircase onto some slick dirt/rock/grass slope and expect me to just take it. Did he not think I would retaliate because he had white hair and thus immunity to any physical retaliation to his fucking ridiculous actions? My condolences for your grandfather but there's a massive difference between these situations.

Whatever he throws at you shouldn't stick, for two reasons.

1) He followed you and initiated the confrontation. That makes it eminently believable that he provoked you.
2) You only hit him once. That makes it eminently believable that your action was in self-defense.

Assault is a criminal offense (as opposed to civil) which means that the burden of proof necessary is "beyond reasonable doubt".

He's also going to have a hell of a time sticking you with his medical bills without a finding that his injuries were not his own fault.

I think the first problem you would have if he did decide to sue was that you (technically your friend) were doing something wrong. I can totally empathise that sometimes it's not easy to stop someone whilst you're driving, but from a law point of view it's your car, your responsibility. If they get you on anything they could either get you on the fact that throwing something from a car could cause injury or on the whole littering thing. I believe in Santa Barbara they can fine you for littering and I don't know for sure, but here if they see you throwing something from a car it's deemed as littering and you can be fined. That definitely doesn't warrant him hitting you, but if no one actually saw him hitting you, he could claim that he was merely following you to report to your dean because 'you' did something wrong. By the by though it's likely he's going to argue that whatever he did was provoked by your initial wrongdoing of throwing the book out of the window.

The second problem I think you'd have is with the whole self defense argument. Sure, he could have been going to his car to get a weapon, he did almost try and run you over (but do you have witnesses?) and he made the first attack by almost knocking you back. However, when you pushed him you said you:

There were definitely witnesses to this part, according you what you said. If you do something out of self defense you won't often do something like call the person a piece of shit.... you're doing it to protect yourself. Here it almost sounds like you're provoking him, which might not fly in the self defense plea.

Why the crazy fool would follow you in his car and intentionally want to start a fight is anyone's guess... probably had a bad day and wanted to take it out on someone. Or one of these self righteous asshats who believe they have to uphold justice due to some moral leaning. But your friend was doing something wrong. I don't condone the crazy old fool but I'd advise you get some less moronic friends.

Well, as long as Mioko goes over it with his passengers first, there's no evidence that they even threw the book. The old man claimed the book he was holding was the one you threw. Just have your friends and yourself deny there ever was a book, and when it goes to court and the guy tries to suggest the one he was holding was the one you threw, *then* tell the judge to look at it and see if it looked like it was thrown out of a car and ask how the old man managed to retrieve the book then chase you down. Don't bring those questions up before that point, so you don't give him any time to prepare an answer.
