Small Car Accident question

So my girlfriend was using my car to go park on campus to go to her tutoring job (Arizona State). ASU is a big clusterfuck, even moreso than usual this year, but she was gonna park in visitors parking and pay. She pulls up to a spot and she's gonna back in, so she turns her blinker on and after the spot opens up she starts backing in. Another guy starts pulling forwards into the spot and they end up hitting each other. The damage, from what she told me, was minimal. No dents, just a few minor scratches. The guy gets out of the car and starts yelling at my g/f and saying it's her fault and calls the police. Mind you, he doesn't speak english very well, and is obviously very foreign middle-eastern, so it's even more frustrating trying to understand him. He pulls people from around the "scene" and tries to get witnesses to say it's not his fault. He calls the police 3 times, blah blah.

anyways, the police can't do anything, private property, but they take down some information or whatever. My g/f spends 2 hours (misses work) dealing with this shit because of some minor scratch this fucktard caused. She gives them my insurance information. A few police officers later, they say it might be HER fault, because she's supposed to give right of way when you're backing up. When asked why the guy pulled into the spot and hit my g/f, it was something like "I didn't even see her." Good defense.

Anyways, things are still kinda unfolding, obviously there's nothing we can do until the guy files an insurance claim (he might think differently after he realizes the deductible is gonna cost for than a scratch repair) But I'm just wondering if anyone has experience with this kinda stuff, if my insurance rates are gonna go up, and what to expect to have to do in the near future.

Thanks for any input. I'm not really worried over a scratch, I just wanna know my options.

Do you have like other drivers insurance that covers when other people not on your policy drive your car?

I'm not sure if your rates will go up because she was driving it or not. Was it one of those parking spaces that look like an H ? I'm pretty sure that if you want to cross the line in those kinds of spaces you're supposed to treat it like a stop line and wait, so I'd check into that.

Don't know about your state, but in FL, if you are PULLING FORWARD into a parking spot, and you hit someone backing in, you are 100% at fault.

I believe they can file that as a no-fault, not sure what your regulations are, but either way, it shouldn't end up being a huge deal.

And yeah, as shatty as what he did was, sadly its kinda the way you need to go about those things to keep your ass clean. NEVER admit fault, even if its 100% clear it was - sometimes you can get away with no-fault with those things, and avoid a rate hike. But the second you even concede that maybe perhaps it was you... they nail you, especially since this guy is calling the cops every five minutes, asking em if they want a fresh shipment of donuts.

Even if its small, I know how frustrating it can be. That sorta thing happened to me, except it was a brand new car, my very first car, and my very first day driving it... Was sittin' at a stale red light (not jerking to a halt at a new one) when some guy comes up and rear ends me... not going very fast, just kinda tagged me, but it left a niiiiice rectangular license plate print on my rear bumper, the first scratch on the car, and huge gouges where the screws were. The guy took off, too, got his plates but they weren't registered.

Talk to your insurance company, thats a good place to start. Sometimes I wonder why people just don't ask the ones with the relevant information about your situation instead of the crazy internet mob.

It depends on state laws and the school security policy and what-not.

Usually the person that's pulling in to the spot normally will gain precedence in the situation. Parking spaces were not meant to be backed in to, so the other guy might have a legitimate claim. Although it's kind of hard to miss another car backing in to the same spot as you were parking in unless one of both of you were pulling in to the spot extremely fast.

Sometimes things that seem like minor dents or fender benders may need to repaired and people will do whatever is in their power to make someone else's insurance pay for it. People avoid rate increases like they are poisonous gas. I work at an insurance company so I'm used to it.

It's like... something you can fix for $50, or if you're me, just forget about it because my car is a pile anyways just like HIS. why even get insurance involved?

It's rare but sometimes something that seams like a small fender or scratch can lead in to bigger problems.

A client in our company had someone "fender bender" him from the front. The cars hit somewhat hard (it was in a parking lot), but there was only a small dent and some paint damage. A couple weeks later he found out that there was extensive damage to his radiator or something like that.

Insurance rates aren't taken lightly so people try to milk out as much as they can. I fender bendered a guy 2 weeks after I got my license, and he filed claims for severe back injury (there was nothing wrong with his back).

That's just how some people are
