It's not just a felony automatically because it was a fraudulent charge. Depends on the actual statute and what the penalties for it are, which is often times money based. If you can cite to the actual USC code or something which makes it a federal felony be free to. But crimes can have a lot of graded levels depending on the amount involved and the actual physical damages here are quite slight.
I'm not just speaking out of my ass on that either, I actually am a law student. Not saying you are wrong, but am saying that's way too sweeping a generalization to make about it unless you are actually aware of the statute for it.
