Lots of judges, especially lower court judges, try not to make any kind of ripples smart or otherwise. Perhaps if he was willing to go through the appeal process he might have a chance... perhaps. but if he did go to small claims court he could hope that the other dude does not show up. Then there is a chance for automatic default that he would get verdict in his favor.
