My wifes aunt owns a spa in astoria, ny. she is on vacation right now in china and my wife is running the business ATM. these 2 cops come out of no where, enter the spa and start demanding to speak to the manager. They start to question my uncle-in-law and since he does not speak english much, he's like huh? and turns to my wife. the cops demanding stuff and my wife tells them she is china. I interrupt them and politely ask them what this is about. They ask me who I was and I informed them I was my wifes husband. They asked me if I had any part in this business and I of course, said No and they go back to my uncle and start questioning him like he's some criminal. My wife turns to me and I ask her in a low tone of voice if they showed her/have a warrant. The cops turn to me and asked if I was a lawyer. (I'm not) and informed me that I should keep any legal advice I have to myself (WTF?!)

They ask for my aunts name, put their business card down and leave. I'm no fucking lawyer but I've watched so much CSI to know you're not suppose to step foot into a place of business and start demanding stuff without a warrant and if you're just conducting an investigation then you don't tell me to shut the fuck up. In the end, they're just looking for someone who worked here before.

I'm thinking of filing a complaint but would like to know If I was wrong by asking for a warrant etc

As far as I know (and no, I'm not a lawyer either, yet) they don't have to show you a warrant if all they're doing is asking for information. If they had touched anything without your permission, or refused to leave when requested then yes, they'd need a warrant. Don't get me wrong, they seem like a couple of assholes from what you posted, but I don't think they did anything that you could get a complaint to stick for.

unfortunately as soon as I asked for the warrant, they left in less than 30 seconds. I didn't get their badge number but if they do return I'll be ready. from the sound of it, They don't seem they won't be back because they just left a card.

They were just being assholes, so, I guess you can file a complaint for that. Unless you are leaving out some extremely incriminating events out, then you're probably looking at calling for naught. I'm from KY, but I'm sure the NYPD doesn't have the time or patience to deal with your petty whining (no offense, seriously) about an asshole police officer. Also, I was parked at the mall the other day, and when I walked out, a police patrol car front bumper was touching my front bumper. Fucking asshole hit my vehicle. I thought about calling in a complaint, but I didn't.

They were asking information from a business did not need a warrant. Did need your opinion on the matter either as you didn't own the business. They could have detained you and be perfectly in the right to do so. Warrant are only necessary for searches and seizures(if they have the time to get one but thats a longer explanation), Asking for the manager/owner is neither. They left a business card so they were likely looking for someone that worked their previously, they are well within the right to do that.

P.S: CSI IS A TV SHOW don't take it for the word of Christ. Best bet is to stfu if you aren't involve in their questioning shit from a tv show won't help anything.

No warrant is needed to conduct a investigation like that.....were they assholes for no reason, sure they were.

Thing is, the spa is a public place...... during normal hours of operation. They can come in and ask any questions they want, do you need to tell them the answers? Nope, but you can't lie to them either.

Now if they came....when the store was closed/locked they would need a warrant because the area is closed to the public off hours.

CSI and pretty much every law/police show on tv is a load of crap.

To walk into a place of business I don't think they need a warrant. check into that but I'm pretty sure that Cops can walk into any public area of a business, like front of store, but not like the storeroom or a manager's office.
In concerns to the way they spoke to you, your kinda SOL, now had they poked anyone or gestured to their guns you might have something, minor tho it might be with the poking thing.

Also are you sure they were cops? did they say they were cops or just flash their badges?
A lot of organizations which are not truly law enforcement like to make people think they are cops. Child services, various inspectors for shit like health or safety etc.

Cops are generally useless. I've dealt with a few in various situations, and they were about as useful as a GM.
