    Cops can take you in for talking back and getting in the middle of an investigation. Your better off letting them do their job. The guy their looking for could be dangerous and innocent people could be involved and your sitting here thinking their abusing their powers.

    An anyone who says cops are useless is a fucking retard. I for one would not want to live in a world w/o law enforcement.

    The cops went to "your" business because the person that they were looking for used to work there. Now, the cops could:
    a) file for the proper warrant, which is a bit of a hassle
    b) just walk in and ask

    which would you do? Even if you asked them to leave, they would come back in 30 minutes WITH a warrant and ask you anyways.

    First off, they couldn't have detained Zigma, get off that fucking boat already. I didn't even graduate law school, yet this is pretty fucking simple. The cops busted in, asked for the manager. Zigma's wife tried to take care of it, but wasn't legally able to give them what they needed as a fill-in (as in she can't access records, if she knew the person in question personally, i'm sure it's a different territory). She doesn't, and shouldn't be able to give out any information regarding current or past employees. The police realized this and started in on the Uncle who obviously couldn't speak english. You think they were speaking to him because they enjoy barely understanding people they are questioning? No, they couldn't go through his wife (unless they were too god damned lazy to call a translator and used her [in which case any incriminating info from said investigation cannot be used without an official interpretor, as for all they know, she could be feeding them a line of complete bullshit] <somone good at wiking litigation can check that for me, my memory is hazy at best>). So now, the only people they can obtain any information from is the uncle. Therefore, the questioning can only shift to him, and Zigma's wife becomes the god damned observer in this instance. So, zigma and his wife, for all intents and purposes, may have well been sitting on the sidewalk smoking two fatties and talking to each other. The police pretty much did all they could do, which is to tell him to shut the fuck up. So, in a grand summation, Remy0, no they couldn't have detained him without him interfering with questioning, because he wasn't, because she couldn't be questioned regarding the situation. To the above poster, there's a lot of gray area between "talking back" and "getting in the middle of an investigation".

    Edit: I know this from watching a lot of Matlock and seeing a lot of questioning in my days...

    Probably only if you could show that they weren't there in good faith. Same reason why drugs found in an unrelated search are permissible evidence even if their warrant/suspicions weren't drug-related initially.

    A few years ago, Me and my sister had a party and a cop knocked on the door and someone opened it and the cop came in. One of the kids at the party said to the cop you can't just walk in here. The cop told the kid to shut up and he went through my house looking to see what was going on(We had over 200people in a small ass 3 bedroom house, we had people chilling on the roof. crazy shit) anyways the kid kept talking back to the cop and next thing we know the kid was in the car handcuffed.

    The cop told us to lower the music and we can keep the party going, the cop left the door open and the kid ran down the street in cuffs, the kid got away doubt they even searched for him but the cop still arrested him for getting in his way. Which leads me to believe a cop can arrest you if you get in their face.

    If you ever get on the job, or actually know anyone on the job..... shit is situational. I'm the nicest guy in the world, but for certain things you gotta be a complete ass to get information. Most investigations, if your the nice guy you get the whole "I plead the 5th yada yada yada yada" then you have to do stuff the hard way, and usually there is nothing there and could've been settled by the person just saying there was nothing. Just like if a officer pulls you over....and wants to search your car (for whatever reason) if you got nothing to hide, let the officer search. Ya you got your civil rights, but in the end you don't give consent to search its your time be wasted (and taxpayer money) while the officer waits for a K9 unit to respond, and in the end the officer is still on the clock and could care less.

    Now if a officer is a general asshole, sadly it gets stuff done quicker. I don't know if its the intimidation factor or what, but you get the information you need without the whole "fuck you pig" stuff.

    *note* and by asking questions, where he is not affiliated with the party being questions it is considered interfering with a investigation. Its the same way if a officer is arresting someone, and you run over claiming hes a good kid/waste time..... can be detained for that.

    okay, so on a totally different note, I read from various internet websites that they can't search your car unless you give them authority to do so. So they can be assholes and detain you for absolutely no reason and wait for a k9 unit?

    They dont always need permission from the driver/owner to search the car. If I pull someone over, leaving a known Drug house (happens everyday). Theres of course no way I could actually prove anything, by simply pulling them over. So if the driver starts acting shady, seems nervous....or even worse is able to make me nervous by reaching for something/sudden movements in a area. I can take him out of the car, simply due to my safety while I investigate why he was leaving this widely known drug house. Of course, they will not give consent to search (makes me believe even more something in there). So I will take a walk around the car, looking inside from the windows (not actually entering the car). If I see any drug material, scales/baggies/pipes/actual drugs/Firearms..... if I can see it from the window, it gives me probable cause by federal law to do a threshold inquiry (Civillian term would be search) without any consent from the the owner/driver.

    Now if I cannot see anything, but I had to detain the driver due to being nervous.... I will radio for a K9 Unit. Majority of the time, there is not one able to come out. If thats the case, nothing I can do and the driver goes on his way. If there is a K9 that can come out, we wait til his/her arrival and the K9 will sniff the outside of the car with its handler. If the dog picks up any narcotics/firearms/explosives again, under federal law it gives us probable cause to conduct a threshold inquiry without any consent yet again.

    That sucks lol. If you keep the door closed the cop can't come inside. Happened at my friends house a few years ago, he just opened the inner door and left the screen door closed, and talked to the cop through the screen. If we were dicks he could have just come back with a warrant and arrested us for supplying alcohol to minors. But we listened to the guy and kept the noise down, and they didn't come back to bother us.

    Do you live in NYC? I don't think so, I'm majoring in Judicial Studies and NYC law. Without a warrant for arrest or search ALL they can do is ask. If you ask them to leave without a warrant according to law they must leave. You also don't have to answer shit because they can't force you to. If they want to ask you something they'll go through the paperwork and do it. They were being lazy in their investigation and deserve the trouble. They have no right to be there without your permission.

    Other than leaving the part where at that point his wife was speaking to them, you are spot on chap! Had he kept prodding, I'm sure they could have detained him. (If you want to be a smartass about it, however, they could have said "This guy feels threatening", and detained him, terry stop allows that, but using that logic, you could detain anyone for anything, thus why it's absurd in this instance). In the current summation, then no. And to answer your question regarding what classes I took before bailing, yes, I did 2 classes on Torts, which is what would apply here.

    That's what I said? Why hassle them and be pricks you are just going to have to answer their questions anyways? There is a thing called courtesy in this world and you would think law enforcement would get some...but I guess it's too much to ask. I guess you could say they were being lazy but honestly, I'd do the same thing if I were them 9/10 people are just going to answer your questions and you leave. It's the dickholes that say "GTFO" that are annoying as shit.

    Because if they're going to be dicks about it they deserve to have trouble for it. All they have to do if they want to be dicks is have a warrant, then they can do w/e they want. Theres no need to give courtesy to those who aren't courteous, and most NY police officers know better because people will tell them to fuck off in a heartbeat without a warrant, then they'll have to get one anyway.
