    Clarification on Sexual Harassment

    So I am kinda in the middle of a dilema and am kinda confused as to handel this situation and your opinions on the matter.

    I work in the construction industry. Everyday we have supply houses deliver material to the job sites. One of the supply houses has a lady driver. She can be the nicest lady and the next day be a royal bitch. Well anyways last night I went out for some drinks with her boss and a couple other salesmen from the supply house. It was mentiond that she was being transfered to warehouse because they were getting quite a few costomer complaints about her doing delivery's. In my intoxicated state I said something to the affect that "mabey if she didnt talk about her sex life every time she dropped something off they would complain less." Next thing I know all the guys shut up and the head guy looks at me and asks me if I would testify to that in writing. I was like WTF. I thought she told everyone about her sex life. She has that kind of personality. Come to find out they are not happy having here there and even with the complaints they still cant fire her. But if I testify to her telling me about her sex life they can say she sexually harrased me.

    Now yes she did bring up her sex life(or lack there of) on numerous occasions when she would drop material off at my job site. I have 2 employees who were standing with us to back up the fact that she did bring it up. And by bring it up she was actually trying to get me to find a guy for her to play with and on one occasion propositioned me(not that in a million years I would do it). Now I dont know if this should matter but she is a rather large lady(like 350+) so the thought of her sex life makes me cringe.

    I have talked to my employees and my wife about the situation and I am really torn. On one hand I can see that had the roles been reversed I would have been strung up on sexual harrasment charges overnight just because I am a male. On the other hand this is the construction industry and if you dont hear about somebodeys sex life atleast once a day you feel out of place. The fact that this company is asking for my help makes me feel like they are being a little shady but also I know of 2 other construction firms that have quit using this supply house just because she is the delivery driver and she can never find her way to the job site so the material never gets delivered on time.

    So BG whats your opinion?

    Thats what I told the supply house but when you deal with a predominently male industry, firing a lady is damn near impossible. She will just come back on them saying she got fired because she is a fat lady or some shit. I have seen it happen. I swear 90% of the women in this industry get into it just so they can get fired and file a lawsuite. Hence why if I calim she sexually harrased me they can fire her with a clear mind and not have to worry about the litigation. Weather she stays or goes does not affect my business.

    I believe you have to let her know it is unwanted before it can be sexual harassment.

    However, a victim of harassment need not always confront his/her harasser directly, so long as his/her conduct demonstrates that the harasser's behavior is unwelcome.

    Bottom line is I don't think you want to be labeled a rat, that's not a title easy to shake. If the other guys on the job have such a problem with her, let them rat her out. If you don't have a problem with her then fuck it, it's not your business to get someone fired no matter how bitchy she is. She didn't do anything to you, and you never know what's going on at home (she may be supporting her grandmother for all you know) and it's not your right to mess with that unless you really feel you've been offended by her. Also, it's far too easy for other female truck drivers to take revenge by filing a complaint against you, as you stated women for some reason automatically get the benefit of the doubt in such cases.

    tl;dr dont get someone fired unless you have a real reason to, and this could easily come back to bite you in the ass.

    They probably are trying to establish a history of her acting inappropriately. Chances are if you are the first person to, for lack of a better term, go on the record about her behavior she will only get a warning.

    I doubt she gets fired over one incident. For some reason it seems ridiculously difficult to get rid of a woman for sexual harassment but for a man it's one strike you're out.

    For what it's worth, I went reported a female co-worker for making inappropriate comments towards another female co-worker. She managed to twist it around into everyone hates me and just wants to get rid of me and generally made working there even worse than it was before.

    oh, and yes the woman making the comment was fat and ugly. Also I'm female as well. Women all hate each other and make life miserable for the rest. sucks.

    Still, report her.

    yea thats clearly what you said. From what he's been posting he seems to go along with the conversation, if she doesn't know it is unwanted then how can she know it's sexual harassment?
    It is important for the victim to communicate that the conduct is unwelcome, particularly when the alleged harasser may have some reason to believe that the advance may be welcomed.

    Around where I work it's basically this when it comes to sexual harassment: "Anything that makes you feel uncomfortable," that's how fuked up the policy is lol. I hope where I work there's a rational person in charge of human resources/affairs.
