I completely agree with this. Republicans who complain about the Supreme Court are some of the most ignorant people on the planet. The only thing we can go do to save any respectability the Supreme Court had is to elect Bob Barr [(or Ron Paul)or both]!

while I'd say "activism" has largely enacted a lot of good things for the country, I just find the contradictions in terms and whatnot to be humorous. Especially as McCain would be in position to fill a bench that could likely overturn Roe v. Wade, which would require as much or more "activist" interpretation to overturn than to make it in the first place, imo. Same with an anti gay marriage legislation, which Amendment 14 Section 1 pretty cleanly protects.

The problem with judicial activism is not that laws can be repealed or previous cases overturned, it's the fact that laws are getting made based on the whim of the Supreme Court without legislatures having input into it. The Supreme Court is here to uphold or strike down laws based on the Constitution, not create them. That said, this (child porn law) is not really a case of judicial activism in the original sense...unless you consider activism as upholding/striking down laws on a partisan level.

Judicial activism isn't really partisanship, it's more or less being able to read the Constitution as a critical thinker rather than a mouth-breathing "well I don't see those words in here, so this is unconstitutional". Of course there will be some issues in interpretation (like this current one, saying that the First Amendment does not protect the right to say "hay guyz I have sum CP") and subjectivity will always be a factor (even though I generally find most SC judges to be pretty tempered). The partisanship occurs when you have both sides doing it/supporting it, but one side calling it judicial activism with a negative connotation when it doesn't go their way.
