    Uh, the part on the report where the officer said the cyclist intentionally ran into him, knocking him to the ground, and caused lacerations... is definitely false, as the video proves. The officer made the contact, and wasn't knocked to the ground because of that. Note that articles say how the department took his gun&badge away and put him behind a desk when the video was made public, as they are investigating with good reason to.

    The detainment I'm referring to is the night in jail for weaving through traffic. That's a ticket, not jailtime.

    oh and about the disobeying an order thing... well, it's hard to tell for sure on the youtube video, but we don't hear/see anything that indicates an order being given. gonna watch it again, but I don't recall any kind of gestures either.

    What the smoking gun posted, if the court proceeding paperwork the DA filed/wrote up....not the officer involved. It could be possible, the DA didn't believe charges would mean anything so he altered it himself. It also could've been the officer did lie on his incident report, or it could also be a nice typo in translation on the DA's part.

    We will never know, because incident reports that require a internal affairs investigation rarely get released outside of the department.

    Well it's not a typo, lol. Whoever cooked up that document clearly did so with intent to paint any injuries from the incident squarely as the fault of the bicyclist.

    The document refers to the office as the deponent, which indicates that it was his deposition testimony that was the source for this document. I certainly hope he's not lying in his deposition, because that's going to cost him more than just his job!

    Evading police wouldn't bring jailtime? If the Post sources aren't bullshitting, he yelled at the guy to stop and walked toward the biker, and he (the biker), very obviously, made a b-line away from the officer.

    from the video, it's at least obvious that the officers didn't flag him down or anything. I can't tell if they yelled at him to stop- youtube vid is too blurry to check, and the audio doesn't deliver in favor of the cop either (but it is a camcorder audio; only thing you can clearly hear is the guy telling his wife to get back lol).

    You can't hear the cop deliver a healthy body check either, only audio in very close range. I'm guessing a cell phone video since they pick up directionally. I'm just quoting sources from the New York Post, you can feel free to post sources from CM, I'm sure they're unbiased >.>

    Edit: Seriously, trying to refute an argument by discreditting the media is really sad, there's not a credible media outlet out there.

    Tyche, the New York Post is a tabloid :/ Pardon me for taking what it says with a grain of salt (http://en.wikipedia.org/wiki/New_York_Post, look at the sidebar).

    I'm not trying to argue that the audio is conclusive btw, if that's the impression you got. All we can tell from the video is that neither officer made any kind of gesture; the officer in question had his hands at waist level all the way up to the point where he made the hit.

    Not to sound like a dick or anything, but if its not CM it doesn't count.     note: The officer in the video didn't flag for the cyclist. This doesn't mean that other officers didn't try to. We don't know shit about the situation, so implying that no one tried to flag him down is incorrect, we can only infer that the officer that tackled him did not flag him down. And even as you said, we can't hear the audio very well, so who knows if the cop shouted something at him.

    The thing that really irks my bean, is that you are giving full benefit of the doubt to the cyclist, like he wasn't doing anything wrong, and you don't know that for sure. Most people here who are arguing for the Cop are willing to say that the cop was in the wrong for using such harsh force, but you aren't willing to admit that maybe, just maybe the cyclist was doing something wrong. You have all the same information that we do, but you are acting like you know FOR FACT that the officer was in the wrong and that the cyclist wasn't doing anything, and unless you know something we don't, you don't know that for sure. If you have any info you haven't posted, I'd definately like to see it.

    Why am I giving "full benefit of the doubt" to the cyclist? Might have something to do with no proof of him committing a crime, unlike the cop. And as I keep reiterating, if he was in violation of traffic laws then him getting a ticket for it is no problem. But being accused of assault? lol.
