I have to admit though, the refs were sloppy on both sides, Howard got away with a push to Gasol but called a foul on fisher, and Kobe threw an elbow when passing to fisher that lead to that 3 pointer. Also, I just realized that these East Coast games are starting at 9pm and ending at midnight so I can see how they can be tired...

Yeah it was incidental, he kind of just ran into Kobe's elbow in a way but you never know how teams/the league will react.
